Victor Davis Hanson - Two Sets of Laws for Two Americas
American Greatness ^ | 3 Aug, 2023 | Victor Davis Hanson

Leftwing Democrats are systematically dismantling the constitutional foundations of the U.S.

Two sets of laws now operate in an increasingly unrecognizable America.

Consider the matter of unlawfully removing and storing classified papers.

Donald Trump may go to prison for removing contested White House files to his home.

So far Joe Biden seems exempt from just such legal jeopardy.

But as a senator and Vice President with no right, as does a president, to declassify files, Biden removed and, as a private citizen kept for years classified files in unsecure locations.

Biden’s team strangely revealed the unlawful removals after years of silence.

It did so because the Biden administration found itself in the untenable position of prosecuting the former president for “crimes” that the current president committed as well—albeit far earlier and longer.

Impeachable phone calls?

Donald Trump was impeached by a Democratic House for delaying foreign aid until the Ukrainian government guaranteed that Hunter Biden and his family were no longer engaged in corrupt influence peddling in Kyiv.

In addition, the Left charged that Trump was targeting Joe Biden, his possible 2020 rival.

Yet Biden, with impunity, bragged that he had fired a Ukrainian prosecutor looking into his own son’s schemes by promising to cancel outright American foreign aid.

And the Biden administration’s Justice Department is now targeting Trump, currently the frontrunning challenger to Biden in 2024.

Election denialism?

Trump was indicted by Special Counsel Jack Smith, in part for supposedly conspiratorially “unlawfully discounting legitimate votes.”

Will Smith then also indict Stacey Abrams? For years Abrams falsely claimed that she was the real governor of Georgia. She toured the country in hopes of “discounting” the state vote count.

Or maybe Smith was referring to the conspiracist and former president Jimmy Carter.

He alleged that Trump in 2016 “lost the election...

And Smith is directly engaged in election interference. Let’s hope he eventually serves a long prison sentence for this.

Sadly, he’ll never see the inside of a courtroom, let alone a prison cell.

VDH is in beast mode today on double standards, reminding us the many ways the political class gets away with much much more than they’re accusing Trump of.

You can’t get a stronger argument of a two tiered system than this video juxtaposed to Trumps current indictments.

A two-tiered system of justice indeed!

How many more editorials need to be written on this? I think by now everyone understands it.

FTA——Donald Trump may go to prison for removing contested White House files to his home.

So far Joe Biden seems exempt from just such legal jeopardy even though as a senator and Vice President, he had no rights, as does a president, to declassify files.

Biden removed, and, as a private citizen kept for years, classified files in
unsecure locations....readily available to opportunistic dealmaker, Hunter Biden.

Biden strangely revealed the unlawful removals after years of silence.......
and had stored the docs in an unsecure garage w/ his beloved Corvette.

Biden came clean b/c he found himself in the untenable
position of prosecuting the former president for “crimes”
that he himself had committed.....though Biden did so far
earlier, longer, and much more detrimental to ntl security.

In our Republic, there fundamentally exists a two-part covenant between a legitimate government and the citizenry:

  1. The elections that elect those we agree to be governed by must be free and fair.

  2. Those who govern must live by the same laws as those they govern.

In my eyes, it is that simple.

And both components of that covenant have been broken. We no longer have a legitimate government.

Victor Davis Hanson rightly focuses on the second part, that those who govern must live under the same laws of those who they govern.

With the new charges against Trump, if any of us were sitting on the fence wondering if they really do have their own set of laws, that doubt has to be removed.

“Donald Trump may go to prison for removing contested White House files to his home.”

If so, there will be repercussions. Count on it.

Maybe a national holiday should be declared when certain end up going to jail for their acts. Certainly Smith would be one of those.

Ping! Out to the Victor Davis Hanson list

In 2016, Hillary Clinton’s campaign illegally hired two foreign nationals Christopher Steele and Igor Danchenko to compile falsehoods about her opponent Trump.

Clinton hid her payments behind three paywalls.

Her team, along with the FBI, helped leak the counterfeit dossier to the media and high officials to undermine her opponent—and thus subvert the election itself.

Lying and perjury?

Two Trump aides and Trump himself are indicted for supposedly stonewalling federal investigators by claiming either amnesia or ignorance.

That tact is exactly what James Comey did 245 times while under oath before Congress.

What do former Director of National Intelligence James Clapper, former Director of the CIA John Brennan, and former interim FBI Director Andrew McCabe all have in common?

All three admitted they flagrantly lied either under oath to Congress or to federal investigators.

The three were never indicted for their false and perjurious testimonies.

Prof Hanson is at his very best here. Well worth your time, and well worth a clicky to head over for the full article.

Maybe Prof Hanson could be Trump's new press secretary? At least, the vocabulary would improve among the gathered press.

The only reason it is still happening is because Speaker McCarthy took the Bribe Money to keep the CLUB intact with him at the head of the table. He could have STOPPED all of this on Day One.

“U.S. CODE
TITLE 2—THE CONGRESS
CHAPTER 6—CONGRESSIONAL AND COMMITTEE PROCEDURE; INVESTIGATIONS
Sec. 193. Privilege of witnesses
No witness is privileged to refuse to testify to any fact, or to produce any paper, respecting which he shall be examined by either House of Congress, or by any joint committee established by a joint or concurrent resolution of the two Houses of Congress, or by any committee of either House, upon the ground that his testimony to such fact or his production of such paper may tend to disgrace him or otherwise render him infamous.”

Simply look up Hinds Precedents, especially chapters 53 and 51, and Cannon’s Precedents, especially chapters 184-185. You’ll find numerous detailed cases of Congress asserting its power, arresting people, holding them until they agreed to answer questions, and then releasing them. Some of these people did not refuse to appear, but simply failed to satisfactorily answer questions.

Congress has the authority to arrest and imprison those found in Contempt. The power extends throughout the United States and is an inherent power (does not depend upon legislated act)

If found in Contempt the person can be arrested under a warrant of the Speaker of the House of Representatives or President of the Senate, by the respective Sergeant at Arms.

Statutory criminal contempt is an alternative to inherent contempt.

Under the inherent contempt power Congress may imprison a person for a specific period of time or an indefinite period of time, except a person imprisoned by the House of Representatives may not be imprisoned beyond adjournment of a session of Congress.

Imprisonment may be coercive or punitive.

In 1857, a New York Times reporter refused to say which members of Congress had asked him to get them bribes (protecting his “sources” just as various Judith Millers today protect the people who feed them proven lies that costs thousands of lives), so Congress locked him up until he answered and then banned him from Congress.

In 1924 an oil executive appeared but refused to answer certain questions, so the Senate held — literally held — him in contempt. Senator Thomas Walsh of Montana argued that this question of contempt was of the gravest importance, and that it involved “the very life of the effective existence of the House of Representatives of the United States and of the Senate of the United States.” The matter was taken to court, and the witness fined and imprisoned.

Garland’s Memorandum for All Prosecutors states “Impermissible Considerations” for Charging, Pleas, and Sentencing includes “political association, activities, or beliefs” yet here we are with a politically vindictive DOJ. The unwritten rule is “Some animals are more equal than others.” I can’t provide a direct link because it’s in the DOJ’s BS PDF system, which charges money to highlight/copy text.

Actually, we have at least 3 sets of law:

#1. The elite Bidens and their donors are not really under any set of laws.

#2. The thugs who brazenly rob from stores without any fear:Family-owned hardware store lost $700K in just one year due to retail theft
nypost.com ^ | August 1, 2023 | Isabel Keane
Posted on 8/2/2023, 2:08:42 PM by lowbridge

A hardware store in California’s Bay Area had an eye-watering $700,000 in merchandise stolen in a single year — as organized retail theft runs rampant in the Democrat-run state.

Dale Hardware in Fremont documented record losses in 2022 due to the brazen larceny, owner Kyle Smith told The Mercury News.

He said his business loses about $1,800 a day — and that his grandfather, who first began the business in 1955, would “roll in his grave” if he knew the financial hardship the store was facing as a result of the scourge.

“You’ll go, ‘Sir, sir, sir!’ and they don’t even turn around,” Smith told the outlet.

“Or they’ll give you a look, like, ‘Do you want to go there?’”

Retail experts told the outlet a variety of things have led to the current shoplifting crisis, including an increase in “organized retail theft,” or social media posts that have seemingly prompted people to flock to stores and steal.

-snip

Other shoplifters brazenly filled a shopping cart with $11,000 in specialty wire, and kept an accomplice at the door to warn employees against pursuing the thieves because they had guns, Smith said.

-snip

Staff at the hardware store say they only call the police when the loss is greater than $10,000 because authorities are unlikely to hold the perpetrators accountable over lower-level amounts.

Other Bay Area businesses have also reported a disturbing uptick in retail theft, but many incidents don’t get reported so the problem only persists.

-snip

The store owner recalled one woman who showed him a list of items she had been tasked with stealing by an Oakland man who sent a dozen thieves out to shoplift each day in the Bay Area.

“She had already been to Target,” he said. “She’d been to Home Depot. She’d been to Lowe’s.”

3. The set of laws where Trump or we can be tried for what we believe in. Where no laws were broken.
