Judge denies Jack Smith's deadline request, leaving classified document trial date in doubt

A federal judge in Florida denied a key deadline request on Thursday from special counsel Jack Smith in the case against Donald Trump, alleging the former president unlawfully retained classified documents.

United States District Judge Aileen Cannon's decision, in which she rejected Smith's request that Trump notify him by mid-December of any classified evidence he plans to use for his defense, is yet another indicator that she is likely to postpone the trial's start date.

The trial is currently set to begin on May 20, 2024, but Cannon said last week she would evaluate numerous outstanding deadlines at a scheduling conference on March 1, 2024.

The deadlines include requirements parties in the case need to meet under the Classified Information Procedures Act. Cannon's decision on Thursday, related to Section 5 of CIPA, confirmed that anything in the CIPA process beginning with Section 5 will not occur until after the scheduling conference, leaving what is expected to be months of back-and-forth filings that would run into the trial if the date of it remained intact.

CIPA is used in cases that involve classified material and governs how that material is managed in legal proceedings. Section 5 requires defendants to give notice to prosecutors about what classified material they plan to use during trial.

Prosecutors for Smith had asked Cannon to order Trump to notify them by Dec. 18 of which material he planned to disclose at trial from the 5,500 pages of classified discovery that prosecutors had provided to him.

"Providing such notice by a set, near-term date will facilitate the completion of CIPA litigation before the May 20, 2024 trial date," prosecutors argued.

Cannon said in her brief order Thursday that "CIPA Section 5 deadlines, and all other pre-trial deadlines not included in the first batch of pre-trial deadlines" will be addressed at the scheduling conference in March.

The decision is a blow to prosecutors, who have little recourse to fight Cannon's scheduling orders and who have aggressively attempted to keep the trial on track. The decision is, by contrast, a win for Trump, who is the leading 2024 Republican presidential contender and has repeatedly pushed for the trial to take place after the election.

Smith's office declined to comment.

May I ask why you and others are acting like a childish putz? Conservatives have a bad habit of continually eating their own and declaring enemies of those that fail to fall into lockstep. I happen to like both Desantis and Trump. Does that make me an enemy? Are those that prefer different candidates enemies in your view?

Assume Trump gets the nomination and wins. He still hasn’t demonstrated he will be able to assemble a team of highly energized and committed professionals for appointment to key positions and get them through confirmation by the Senate. Without help, the deep state bureaucracies in Congress and the executive branch will tie him down and roadblock his agenda just as they did during his first term.

Good points and certainly pertinent. You did not mention, however, that Trump learned quite a bit during his first term including how to better identify professionals who are less likely to betray him.

Perhaps more importantly, although some such as yourself believe his "mouth and behavior" are a liability, who do we have on the bench with the guts and ability to better confront and prevail over the anti-MAGA's?

Insurance, utilities and local taxes are a city/county issue. DeSantis as gov cannot help you or harm you in those areas.

You are incorrect. Governor has lot of control over Florida Power and Light. It is a statewide utility.

I have to agree with you on what you said. However DeSantis is absent from Florida. He spends more time in Iowa and NH than in Florida. You can’t tell me that is a good way to be an effective governor.

How many times have you asked this question of the unruly snit throwing DuhSaintis groupies? IF Duh-Saintis is now representative of what is called 'conservative', then somebody has changed the meaning/definition of what conservative means.

I became 'conservative', when the meaning was God, Family, and County. Now I am familiar enough with the Written Word I can discern conmen /women... NO God fearing Christian would ever hide out who they meet and greet, from the people they serve ..

I despise people who have and hold double standards, and tell me how I should act.

Judge Cannon is not going to start this trial until after the election. She’s just doing it one step at a time so the media can’t say she is helping Trump. Her rulings certainly do help Trump, but they actually are keeping the case on the normal time frame of similar cases.

The prosecution is doing everything possible to obstruct Trump’s constitutional rights to due process, so Jack Smith has only himself to blame.

Every time Trump goes up in the polls they file another set of fake charges. I hate the look of smith. They have tired a venue change. Next the off the judge.

It's like that EVERYWHERE. I don't care much for DeSantis but you can't lay all the blame on him. Place blame where it belongs. JOE FCKN BIDEN!

I don't think you understand the situation that Florida has in home owners insurance. It's up 50% yes. But it's up 50% from a price that was already astronomical in comparison to rates the rest of the country pays. People in Florida pay in homeowners insurance what people in high tax northeastern states pay in property taxes.
