Trump Must Pay Half a Billion Dollars Before He Can Appeal New York Decision

Former President Donald Trump must pay nearly half a billion dollars as a bond to New York State before he can appeal the ruling by Judge Arthur Engoron last week that he must pay $354 million in fines — over $450 million, with interest — for fraud.

Critics have noted that Trump is the only person ever to be sued under an obscure New York fraud statute that does not require any harm be done, and that effectively criminalizes the everyday practice of real estate valuations in negotiations with banks.

Though Attorney General Letitia James — who ran for office promising to target Trump — claimed that no one is above the law, her case against Trump marks the only such case in the history of the state. And the staggering fine is likewise unprecedented.

If you think someone with a net worth of $8+ Billion dollars and has properties all over the world can’t secure a $500M Bond or loan, you haven’t been watching Donald Trump for the past 45 years.

I guess Trump was just talkin’ trash yesterday when he said, we will appeal.

i heard last night that the U.S. Supreme Court can step in right now and stop this...they did it before. In 1996, BMW got caught selling re-painted cars as new....plaintiff got awarded like 5000 dollars for the paint, but also got 4 million in “damages”...Supreme Court stepped in and squashed the 4 million....

I didn’t say he couldn’t get a bond, just that Truth Social doesn’t enter into the calculation.

My uninformed guess: The appeal will be bonded but only after some effort. Much of Trump’s net worth is in real estate. For each property, you have to ask if it’s mortgaged, and also what the ownership structure is. A property might be owned by a limited liability company, which is in turn owned in various percentages by Trump, his children, and possibly a corporation that’s also part of the Trump Organization. In many of Trump’s investments, he has one or more partners who also have a stake in the property.

Untangling all that, to get a surety company to issue a bond, will be doable but complicated. From what I’ve seen of Alina Habba, I’m not sure she has the legal chops for it. I’m not surprised that Trump is considering hiring an appellate specialist.

When this is all said and done, President Trump needs to sue NYS and Judge Eggnog and “Tish” for both monetary and PUNITIVE damages. Period.

No, the Supreme Court did not "step in" in the BMW case. That's not how the Supreme Court works. There was a judgment in an Alabama state court against BMW. BMW appealed, within the state court system, all the way up to the Alabama Supreme Court. Only after completing the appeals within the state court system could BMW seek SCOTUS review. The same will be true for Trump and his co-defendants.

Precisely. It seems too that “the media” are being myopic as always because all they seem to chatter about is the 350 million dollar judgment against Trump when in reality that amount of money is chump change compared to what this fiasco is going to cost New York State and New York City.

Okay then, please explain the procedure, including citations to relevant statutes, of how one appeals a decision of a trial court to the US Supreme Court.

You cannot sue a judge for anything they do relating to deciding a case. Period. Can you imagine the mess of lawsuits against judges if it was any other way? There would be no legal system.

... Trump is by no means the only person ever to be sued under this statute. It hasn’t been used often, but a quick search of westlaw brings up a handful of cases previously brought under this statute. And those of course are just the ones with published legal opinions.

The fine may be unprecedented though.

Unprecedented fine? Now that is an understatement.

For the masses who do not have access to Westlaw, how about an actual number of the "handful" of cases they cite, and a brief summary of the close similarities?

Or he may have talked to the various and sundry lawyers who share the traits. There seems to be no shortage of big leaguers to argue any godforsaken point of law when the rubber actually hits the road.

Yes... but judges should not be above the law.

There MUST BE a recourse for this.
