I think you are incorrectly reading this to suggest that this rather weak ability of the government to not be bound by express fuctions gives it the power to strip-mine the "residuary sovereignty" of states and individuals. In fact this very passage explicity puts any additional powers of the fedgov outside of this residuary sovereignty. What they are talking about are relatively tiny scraps of federal power, not the wholesale invention of new powers.

OK, here's the equivalent question: Does the fact the federal goverment have some scope to act outside of expressly delagated powers enable it to remove rights from states and individuals that would otherwise be retained by them?

What do they call the Democratic lawmaker who is the worst gun-grabber in California? "Pistol-packing Don Perata"? He's strapped. Sen. Feinstein has a permit, too. Maybe we all ought to start a diamond-importing business in order to enjoy our Constitutional rights, or else become Democratic lawmakers.

A few years back, Senator David Roberti had his political career wrecked by RTKBA activists in California. Instead of misrepresenting the Constitution and engaging in ineffectual whining to unreceptive courts, they used hardcore political means.

Don't know roscoe on other issues except for "some" of the posts here and what I had responded to him about had valid points along with Congressional law to back his views up.
I don't know the cause of your problems with roscoe, but a point of view with evidence seems pretty good tools in a debate.
I don't know about roscoe's or your typical manners or debate techniques at all TP.

Have you never pledged allegience, or take an oath to preserve & protect? How do you justify such behavior?

That's why the Libertarians should get together with the ACLU and challenge the law in court to see if the constitutionality stands up David or falls on it's face.
It is the law of the land despite the feelings of anyone until the issue is brought before the highest court. So if so many believe it is unconstitutional the party should challenge it in court.
I think you have every right to do that David.

You had me worried for a minute. As a CA resident, I would resent your remark, but I'm all too aware of the TX/CA rivalry. (
Heck, I even lost five bucks to a stepson who bet the Cowboys(4-10) to beat my Niners(11-3) the other day.)
The State's gun-grabbers are looking over their shoulders to see if Uncle Sham will rap their knuckles, should they go too far. Seems to me they're still getting a green light from whichever party happens to be in power.
These two parties blow.
