Defense Hopes To Show Child Porn Wasn't Downloaded By Defendant

SAN DIEGO -- A computer expert hired by David Westerfield's defense team said that at least some of the pornography seized from his home was downloaded by the defendant's son.

Marcus Lawson (pictured, right), president of Global CompuSearch of Spokane, Wash., testified Wednesday that he found two photographs of naked women and Japanese "anime" computer animations on the hard drive of a Gateway computer in an upstairs bedroom used by Westerfield's 18-year-old son, David Neal Westerfield. The former Customs Service agent said that a detailed analysis of the files showed the pornography was downloaded at about the same time someone was accessing an email account belonging to the younger Westerfield.

David A. Westerfield, 50, is charged with kidnapping and killing 7-year-old Danielle van Dam. He is also charged with misdemeanor possession of child pornography. Prosecutors have said the 80 or so images of child pornography taken from Westerfield's home indicate sexual interest in children.Defense attorneys are trying to show that the defendant is not responsible for the pornographic images -- including those of young children -- found on his computer equipment.

David A. Westerfield, a 50-year-old self-employed design engineer, is on trial for the kidnapping and murder of 7-year-old Danielle van Dam.

Lawson told jurors that he examined copies of hard drives, zip disks and compact disks made by police and took numerous screen captures -- essentially photographs of what came up on the computer monitor at a given time.

Defense attorney Steven Feldman asked Lawson if there was a theme to the animations.

"A considerable number of the screen prints showed bondage -- where women were tied in ropes," Lawson said.

A screen print of an e-mail to a DNWesthotmail.com, as quoted by Lawson, said: "Thanks for joining anime.com."

Lawson also confirmed screen prints the defense entered into evidence last week, that a computer in the office of Westerfield's house was used to access pornography on Feb. 4 at 4:47 p.m., when the defendant was busy with detectives.

Feldman mentioned last week's suggestion that the clock on the computer may have been doctored.

"Did you see any evidence that that happened on any of the computers you examined?" Feldman asked.

"No, I did not," Lawson answered. He said there's usually signs when a clock has been tampered with, such as files being accessed before they were created. Nothing like that was apparent on Westerfield's computers, he said.

Tuesday, San Diego police Detective Johnny Keene testified that he collected Westerfield from his Sabre Springs home that Monday around 3:40 p.m. and took him to the Northeastern substation in Rancho Penasquitos. The defendant remained there until approximately 11:30 p.m.

WHY DID THE WARRANTS INCLUDE CHILD PORN?????

Because you are always supposed to look for child porn when searching for evidence of a kidnapped child. Hello? That is SOP. It is an investigative assumption that the kidnapping was sexually motivated because the vast majority are, so it is natural to look for evidence of other sex crimes. The warrants also included rope, tape and other types of binding material, because they are commonly used in kidnapings.

At which time i commenced to recite the ignorant americans that feeds nearly a third of the world, lands on the moon, creates 75 % of the worlds computer traffic, and highest standard of living ever seen. And all this existed prior to 1977 --James Carter and his sainted Department of Education.

He then went to the "GW Bush wants to kill all this".
I said "why not ?"

Then I got out the budget numbers (handy thing for you politic-junkies).
It compares Clinton's budget v. Bush. Everything is increased (except for Commerce).

I bought him a beer, but i don't expect to get one back ...

The quantity and quality of DW's religiosity is between him and his Maker.

I don't know. Is it relavent ?

Do you think his life has been Godly?

I know little or nothing about DW's life outside of what I've read in these forums and within the press. Asking me to evaluate someone's entire life as to whether its Godly or not, seems sort or stupid and a waste of time.

We were talking not too long ago about the VD's godless lifestyle, so it would be interesting to get your "input" on this as well.

I was not one of the ones talking about Van Dam's godless lifestyle. I'm not going to travel down that road.

As I have already stated, anything that is a part of the crime scene itself should be open to full investigation and testimony by witnesses, in my opinion. And from there, to full discussion on these threads. The Van Dams bringing strangers into the their house for sex parties is certainly a part of the crime scene where Danielle Van Dam lived at least some of her last moments of life. The old saw about 'not being able to choose one's parent's.' seems apt.

It would appear that some horrible investigative blunders have been made. For example, there is significant physical evidence within the crime scene itself that is not discussed much if at all in testimony. The DNA left on Danielle's bedding did not match David Allen Westerfield. In fact, I don't recall that DNA even being described as semen. Could it have been DNA in a discharge from a woman ? One can only speculate.

Then again there are other interesting things to observe. I think that when someone is apparently consumed with venom and rage, then they have a problem they should deal with, especially when it effects their interactions with others. I think that when someone is consumed with provoking others then they also need to deal with that too. It really doesn't have anything to do with religion per se, it just has to do with normal human dynamics.

Attempting to make my FR profile the topic of discussion on the Westerfield murder thread seems a terrible waste of bandwidth, in my opinion. And once again for at least the third time, I really think your time and effort would be far better served if you just stick to focussing on the thread topic instead of individuals posting to the thread at hand.

My ex-wife had thyroid disfunction.

We went thru the hoops to get her synthriod prescription right.
Weight gain, lethargic, irratable (esp at me).

Switch doctors if you don't feel they got it right.

My profile required little effort simply because its the minimum amount of information about me I wish to entrust to others at this time. The world is not what it once was and people can be and are somewhat cruel with one another. Revealing significant detailed personal information about oneself to strangers is not terribly prudent, in my opinion.

I am open to discussing specific topics within specific threads.

For example, if the thread, "Alright Pyx ! Reveal everything about who you really are !" appears and there are several hundred postings on it, as drop-jaw amazed as I'd be that anyone really gives a hoot, I'll be more than happy to pitch in. :9

Likewise if there's a long thread such as "Describe your personal religious beliefs in detail.' I might post to it or I might not. :9

However, seeing as these threads are devoted to the Danielle Van Dam murder, I'd sort of prefer to limit my ramblings to within the scope that topic.

I will say that the defense needs a NOT GUILTY verdict. If there is a hung jury/mistrial and the prosecution gets a second crack at doing this, they will get a guilty verdict the second time around.

It takes ALL 12 to Convict; it takes ALL 12 for Not Guilty. Any other jury conclusion results in mistrial, and the strong probability of another trial of DW.

So far, the murder was committed by:

1. David Allen Westerfield,
2. Someone from among the Van Dam household and visitors,
3. Unidentified "outsider."

Notwithstanding the Wednesday testimony, the greatest amount of evidence remains against DAW. Wednesday may have eroded the strength regarding the child-porn on the computer, but did not touch the other evidence pointing to DAW.

I predict at least one juror will hold out for conviction of DAW, based on the physical evidence (blood, DNA, fibers). Result: Retrial.
