I have heard a number of talking heads ask what harm would be done by allowing the Democrats to name another candidate, and making this a "campaign of issues." The filing deadline law doesn't seem to matter anymore.
But it matters more than ever in this age of Campaign Finance Reform. Candidates are limited on what they can raise and what they can spend. Forrester has undoubtedly expended considerable of his allotted resources on ads and strategies which center upon the opponent the Democrats have already named to run against him. When some judge decides that a new candidate can replace Torricelli, will he also decide that the Democrats compensate Forrester for the money he spent preparing to run against a phantom candidate?. Will contributors be allowed to give more money to make up for the wasted funds if the Democrats are not compelled pay damages to the Forrester campaign? Will Forrester be allowed to spend it?
And what about all those people who could only speak their piece up to 60 days before the election? Will they be given some time to comment on the new candidate, or are they just out of luck.
Torricelli has to stay on the ballot. He can make it clear to everyone that he will resign if he wins, and the Democratic Governor here will then appoint his replacement, presumably a Democrat. What's wrong with that?
