For the past three years a small group of concerned people in Britain have been carrying out extensive research into our nation's constitutional law under the guidance of leading counsel, Leolin Price CBE, QC. As a result it now seems clear that successive governments of this, the world's oldest democracy, have exceeded their parliamentary powers by entering into various treaties with the European Union. In so doing, since 1972 they have progressively surrendered our national independence and sovereignty to a foreign power, when the British people originally believed they had only consented to beneficial trade relations with the then EEC. In our view this must be unlawful because it contravenes our ancient Constitution, especially the Bill of Rights which is still in force today.
Our Parliament is dependent on being selected by election every five years or less. The electorate chooses the incoming administration to govern on their behalf within the constraints of the Constitution. Parliament does not, in our view, have the right to transfer its authority and responsibilities to an unaccountable and unremovable foreign power, and thereby disenfranchise the electorate. We are therefore mustering support to challenge the Government's legal powers to surrender Britain's sovereignty and self-governance, by pressing for Judicial Review in the highest courts in the land. We are asking the judiciary to declare the law, and Parliament to uphold the law of the land on all issues at home and abroad, in accordance with the Constitution.
No man, be he King or Commoner is above the law. All parliamentarians, the judiciary, the military, the police and senior civil servants, are required to swear oaths of allegiance and loyalty to the Crown. MPs' Code of Conduct requires them to abide by the rule of law. The Crown is still the ultimate guarantor of our freedom and independence. The sovereignty of our nation must therefore be staunchly defended by every one of us who wishes to preserve Britain's inalienable rights and liberties.
This England has pledged a sizeable sum to help promote this vital legal campaign, but we are sure that many thousands of ordinary people right across the English-speaking world will welcome the chance to take part in this new "Battle for Britain" to restore our country's freedom and sovereign independence.
Update
Our unprecedented Constitutional Challenge is at last under way.Our QCs presented a plea for Judicial Review in the High Court on November 6th, and a first oral appeal will be made on December 17th. The Government has been made formally aware of our action, but we are not at liberty to discuss the finer details yet. Indeed, the progress of the case may well be reported in the daily papers long before the next quarterly edition of This England is able to bring you up to date . However, it is clear that this will be a lengthy action, progressing all the way up to the House of Lords if necessary. Even though we are increasingly confident , let it be said that, win or lose, our action will cause many shudders of shame on all sides of the political establishment . For we are opening the door of a hidden cage in which the body of our nations ancient sovereignty has been unlawfully imprisoned, and gradually mutilated, by a succession of politicians and bureaucrats over the past 30 years. It is our fervent hope that by opening that door we shall let the fresh air of freedom flow in to revive and restore our democratic heritage.
Since the campaign was launched last May some 6,000 people -- mainly readers of This England -- have responded magnificently to our appeal for funds, and we have already banked more than £180,000, mostly in small amounts donated by older people, many of whom have already experienced the true cost of retaining our countrys precious freedom through their suffering during the perils of wartime. Naturally, as the case progresses, extra costs will be incurred every step of the way and more funds needed to ensure that no legal avenue is closed to us in our pursuit of the truth. If you wish to take part please send your name & address plus a donation (cheques made payable to Constitutional Challenge) c/o This England, P O Box 52, Cheltenham, Glos. GL50 1YQ.
If we win this unique action , everyone at home or abroad who has contributed to its fund will be sent a signed certificate registering them as a Defender of the Realm. Until then let us recall the words of that great American novelist Mark Twain (1835-1910) who wrote in his 1904 Notebook: In the beginning of a change, the patriot is a scarce man brave, hated and scorned. But when his cause succeeds, the timid join him. For then it costs nothing to be a patriot.
Good Luck with.
