An early-morning carjacking attempt turned fatal for a would-be carjacker whose threats prompted a driver to pull a concealed revolver and shoot him several times, Metro police said.

Jerry Williams Jr., 25, of Wallace Road, Nashville, was dead at the scene after he attempted to carjack a new Ford Explorer SUV at about 1:30 a.m. at the Golden Gallon convenience store at 198 Haywood Lane, police said.

Williams was shot after he jumped into the SUV and demanded that the driver, Billy John Brown, 50, of Ezell Road, Nashville, start the vehicle, investigators said. Williams had first asked Brown for a light for a cigarette when Brown came out of the store, police said.

''Mr. Brown stated the suspect told him to start the car three times,'' night court documents state. ''As Mr. Brown refused and began to get out of the car, the suspect stated, 'I will kill you.' Mr. Brown retrieved his .44-caliber Taurus that was in the seat beside him, and as he got out of the car he saw the suspect raised (sic) his hand up as if he had a weapon, and Mr. Brown returned fire, striking the suspect several times.''

Williams' companion, David Lee Moore Jr., 20, fled during the shooting but was captured shortly afterward, police said. He was in the Metro Criminal Justice Center last night, charged with attempted carjacking.

Brown, who has a permit to carry a weapon, was not charged, and police are considering the shooting a justifiable homicide, police spokesman Don Aaron said.

Aaron added that the shooting will be investigated by the district attorney's office, and he said that there were several witnesses whose description of events agreed with Brown's.

Earlier this year, Brown ran for a seat in the state House of Representatives, losing in the 59th District to incumbent Sherry Jones. He also incorporated Skydive Record Co. out of his home, according to the Tennessee secretary of state's office.

I don't often post a "view source" document; I hope I haven't run afoul of the AM.

Although the victim is more of a "house-wine" type of guy than a "Joe sixpack" fellow, I don't think that made any difference in this case.
