Idiot GOP Senate Set to Shaft Estrada?

I am more frosted at the Democrats for what they're doing to the Constitution vis-à-vis Miguel Estrada's than I am over the anti-war movement. Fox News reported that the GOP planned to call for a cloture vote on Estrada next week knowing they'd lose it. That would effectively amend the Constitution - illegally - to read that you need 60 votes instead of 51 to get a judicial nomination through.

Happily, it turns out the GOP isn't going to call such a vote. The offices of Senators Santorum and Hatch rang up my office on Friday, and said that the Fox story is not accurate. There will be no cloture vote. Hooray! If these Democrats want to filibuster the first Hispanic nominee to the D.C. Circuit Court, let them do it! I know they say there are new rules making a filibuster harder, but so what? And don't tell me that it's not "practical" anymore, because people have to go to the bathroom. That's nothing new.

Force them to get out there and filibuster this eminently qualified man, as rated unanimously by the American Bar Association. Miguel Estrada is just a name to us, but his life is being destroyed here. It's not because he's unqualified; it's because Democrats don't like how he might think. Read George Will's column. Chuck Schumer didn't bother to ask Estrada a single question. He claims not to know any less qualified judge, when in fact he knows less qualified judges who went to the Supreme Court! Just this week, President Bush pledged to stand by Estrada until he was sworn in. We know no other nominee has been asked to give nor should give opinions on issues that may come before the court. Their job is to apply the law, not to make law or let their opinions get in the way of rulings.

These senators have to back Bush and Estrada up. The Democrat attitude is, "We ran Washington for 40 years up until 1994, and Bush is illegitimate despite what the Constitution says about the Electoral College, so he has no right to appoint anyone." These people are treating the Constitution like toilet paper. Calling a cloture vote would overturn more than two centuries of Senate precedent and rewrite the constitutional definition of "advise and consent." We cannot allow that to happen. You have to care about this, folks!

These people aren't Democrats or liberals. They don't believe in the Constitution. They don't believe in individual rights, as affirmed in the 9th Amendment; in sharing power with the states, as described in the 10th Amendment; in free political speech protected in the 1st Amendment and shredded in campaign finance reform. They don't support the right to bear arms provided for in the 2nd Amendment. They don't respect private property rights protected by the 5th Amendment! If there's a blade of grass in the backyard, they call it "wetlands" and take it away! This assault must stop.

You are probably correct. I think they would have to curry favor with their state governing bodies. Unless you'd see interest groups combine to support state elections with the intent of influcencing the appts. of certain senators. Then some states may support each other to get the money or maybe support a warroom effort because of pressure from the interest groups.....

I don't think they have but I don't spend time over there searching their site. But why would they admit it was false? Show me where OJ admitted his innocent plea was false......

But you bud over on the AM dial admitted it was false.... So is he lying?

I think that was exactly what was going on at the turn of the century (land barons, rail barons) that prompted the 17th amendment in 1913, although there were also special interests who stood to gain via the 17th amendment.

However, that was at a period where the West had just been settled, many territories were becoming states, and global communications and single-day continental and trans-oceanic transportion were the thing of Edgar Rice Burroughs and Jules Verne.

Things are different today.

So you advocate posting lies?

My posting to which this is a reply was about posting false reports, not lying reports.

However, if a lying report appears in as prominent a place as Limbaugh's Web site, then yes, I do advocate posting it. I can't think of a quicker method of refuting a lie. Mind you, I am certainly not accusing Limbaugh of lying in this case. If his report is false, I think his mistake was almost certainly an honest one.

Mistakes can be honest. You people are entirely too quick to accuse people of lying. Not only is it extremely bad manners, it happens more often than not to be incorrect and thus bad policy.

I prefer the outdoors... but if I was where the weather wasn't tolerable most of the time I guess I'd have to have indoor equipment. I don't care for Fitness Centers either. I try to ride about 10 miles each day and if it's too bad to ride then I try to walk about 3. Some days are a total washout.

You could be right -- Rush was trying to start a questioning and that he did! It also looks like the headline may be have been written ahead of time with a different story line. After Rush found out the facts from Santorum and Hatch offices the story was changed but the person who did the headline didn't change it.

Other scenario -- he wanted to get Republicans fired up which he did!

Not to mention the original article Fox article and what Senator Frist said were at total odds.

On Wednesday morning the President said he was backing Miguel Estrada all the way, the Senate Republicans took the floor Wednesday night and gave some powerful presentations, and then Fox comes out the Republicans had a bad night! The Republican Senate was NEVER backing down and Fox portrayed the story like they were ready to cave.

You all do realize that if Major Garrett had bothered to do some research, he wouldn't have written a bad lead in to the original Fox story. And also would have included more of the comments instead of taking the comment from Hatch about he could lose totally out of context.

Anyone want to blame anyone then put the blame on Fox News Channel and Major Garrett for not bothing to get the facts. Historical vote a quorum call was not. And a cloture vote scheduled for Tuesday was never in the works. And the Republicans did not have a bad Wednesday night! Those are only for starters that were bad from the original Fox article that Rush took off on.

Mistakes can be honest

They surely can. And the vast majority of us admit it when we've made mistaken posts.

However, when you repeatedly post erronenous replies over months and even years, even after been shown on numerous occasions that you are wrong, one has to wonder about the complete honesty of the poster and their agenda.

Whatever the agenda is here, it's certainly not about politics or this country; it's very self-serving.

I think it was a true story and Frist GAVE the interview and when the GOP saw the damage Rush was doing Friday afternoon from 12 to almost 2 AND HOW UPSET HE WAS AND THE FIRST CALLER WAS UPSET WITH THE GOP AND RUSH SAID WHY EVEN BOTHER GETTING RID OF TRENT LOTT, they (gop) called and back tracked and said it wasn't so.

Again the link that Fox news says it printed a false story besides having a day wrong in it.

I agree with you that posting something like this is good! It allows the TRUTH to see the light of day.

Fox News Channels will probably be more careful in the future about a news story that is written, posted, and then found to be erroneous because the reporter didn't bother to check out the facts! That is bad journalism!

To mix up a Quorum Call vote with an historic cloture vote to end a filibuster of an Appeals Court Judge is not something I would expect a veteran reporter would do. BTW, I am still waiting for Fox News Channel to reply to my email and tell me that their story was wrong!

Fox has never admitted that Major Garrett's story about a cloture vote was WRONG! They just changed a few lead-in paragraphs.

The Editor of my local paper, The Daily Oklahoman, has a policy that when someone finds a mistake and notifies them, they print a correction and explain where they were wrong.

Shame Fox News Channel doesn't have that same sense of journalistic integrity!

TLBSHOW is obviously emotional and impulsive. Because he's also honest, that means he makes unconsidered statements that can be interpreted as anti-Bush. And that means censors who only want to allow pro-Bush statements will always find cause to object to him.

But his sort of unconsidered honesty is worth infinitely more than the dishonesty of sycophants.

At least most on this thread understand that the Fox story was in error and do not continue to defend the story until a retraction is printed.

after almost 5 hours after they called his show Rush still put up his story... does Rush know something?

Have you seen Fox say their story was false anywhere I am looking but can't find it. If you do please post the link..

bottom line is they (GOP) called Rush ONLY after he was steaming about it on his show. My bottom line opinion of course.
