I posted this in the last thread, but ill repost it here re: is this a declared war or not argument
Like Vietnam, Korea, GW I this is not a declared war.
War can only be declared by Congress; this is the President acting as Commander in Chief, however, as per the war powers act of 1974, in 60 days the COngress can vote to bring the troops back, or allow a 30 day extension of the CIC's War Powers. After that 90 days, they MUST declare war, thus giving both executive and legislative approval for any sustained conflict

You sound up to date to me. Apparently the Pentagon has reported that there was panic digging at the first site that was hit and Saddam was seen being taken away on a stretcher. Now there are reports that high ranking military types are fleeing Baghdad.

Yes, but UN or not, the Liberals could bring up charges based on Bush violating the executive order banning assasinations, and that's a constitutional issue, not a UN issue. So the question is, was war declared or not, and can a head of state ALSO be considered an enemy combatant

As between US legislature and President Bush, Bush was granted the power by the legislature, and he satisfied all requirements of the grant of authority promulgated by Congress.
Technically, it is not a declared war.
What practical difference does the formal stature make?

In the eyes of the law it could make a difference, there is a valid legal argument since technically a state of "war" only exists with congressional approval; its all a question of interpretation, thus do the rules apply to all armed conflicts, only declared wars, armed conflicts with legislative approval but not backed by a war resolution... all about the interpretation

I'm sitting here watching tv and seeing all these bomb blasts, and hearing them as well, and then I can hear the artillery fire from Ft Hood right outside my window..it's a little bit eerie.
