I don't know, but I think even if they had consensual intercourse, she can claim assault. There have been cases of spouses doing the same, when it wasn't forced. Maybe not in CO., but I am certain it's happened.

That's been tried before. Since you are a legal researcher, look for a Florida case called State v. John Ted Wright. It's pretty amusing. It is a rape case, and the defense was, well, impossibility. No way this would fit.

I can guarantee you this DA took his time making sure he had a case against such a high profile individual. You can rest assure that the "victim" passed a polygraph test. The real reason polygraph results are not admissable in court is because it would put half the trial lawyers out of business. Polygraphs today have 98% accuracy, a little better than the OJ debacle.
