As I watch Pearl Harbor tonight, I think about the great shame these people do to those who fought and died for our freedoms:

Freedoms that these people abuse for self interest.

But then there's James and his FreeRepublic.com on the other side of the scale, and that's a mighty heavy weight indeed

Here's a way to avoid the photogenic fracas of federal marshals dragging away Victoria Wilson (who's appointment by Bill Clinton has expired). The President simply orders the Secretary of the Treasury to stop cutting checks to Ms Wilson, effective immediately. He also orders that her payments go instead to the new Commissioner, who has been sworn in.

The President also requests that all secretaries and others at the Commission who would normally work for or respond to Ms. Wilson, to state whether they continue to recognize her as a Commissioner. If they say yes, or if they refuse to answer, he cuts off their paychecks as well.

These people are money-grubbing thieves of the taxpayers' money. This would smoke them out of the woodwork, without giving the TV networks a "photo op."

Berry and Wilson are trying to argue that that the terms are no longer staggered. However, once they become staggared (as they were made so prior to 1994 and thereafter validated with those changes) they are forever staggared. Anyone appointed in mid term serves only so long as the original appointee. They have no leg to stand on.

Does the fact that MS Wilson was appointed to fill the balance of a term left vacant by the death of another member? She would need to re-appointed in her own right,I would think, following that terms expiration.

However, Wilson was NOT appointed to a 6 year term, she was appointed to fill the unexpired appointment of someone else. Her temporary appointment is expired. Period, end of sentence, end of appointment.
The term of the person's place she took expired November 29, 2001.

and one wonders what, as a woman and billy boy together have come to mean, and her clinging to her seat like a cat in heat, what favors Ms. Wilson might have had to provide to former sex offender for her position......

Wilson should be honored she was asked to serve her nation. Now that the term of this service has expired she should gracefully step down and be thankful she was allowed to serve.

not true. The original laws for this committee stated specifically that an appointee was appointed only for the remaining term. When it was redrafted by congress they left this out. Also, I searched other committee statues under the same code section and they are explicit about a member only serving the remaining time of a term.

In the intstant case their is no language (like there is in other enabling statues) that provides for limiting a member to the remaining term.

The president had no authority to appoint her to anything less than a 6 year term.

She does not. Victoria Wilson was appointed to FULFILL a term of ANOTHER commissioner. She doesn't have a prayer of winning this.

When it was redrafted by congress they left this out.

It was left out because it was no longer needed. As you can see it applied only to those alread in office on the date that statute was enacted. This is very common in legislation - to clarify how it is to be applied to the status quo at the time of passage and then many years later go back and remove it when its no longer relivant.
