A federal judge dismissed McLennan County as a defendant in a civil rights lawsuit filed by three bikers arrested after the 2015 Twin Peaks shootout but ruled the plaintiffs can pursue claims against the city of Waco and seven individual defendants. The McLennan County District Attorney's Office dismissed the case against Twin Peaks shootout defendant Cody Ledbetter on Monday, four days before a jury panel in his case was supposed to report to court. The dismissal, signed by prosecutor Michael Jarrett, says that while probable cause remains in the case, the state is focusing on more culpable defendants in the Twin Peaks shootout, which left nine dead and dozens injured. According to KCEN TV, the Bureau of Alcohol, Tobacco, Firearms and Explosives blasted water on the container found just outside Rosebud off Farm to Market Road 1963. Rosebud, about 40 miles southeast of Waco, is home to about 1,400 people. Flammable liquid and shotgun shells were found inside the container, according to Sheriff Parnell McNamara. He said the IED was designed to blow shrapnel and would have been "extremely dangerous" had it gone off. "Someone had made this to create lots of damage and harm," McNamara said.
