Can Durbin be sued for his comments. Assume: a) comments were slanderous per se b) Durbin knew of their falsity and made them for simple political gain c) the potential damage to the slandered party, the American soldier, is not just defamation, but increased likelihood of death on the battlefield. Would a court view this not as protected political speech on the Senate floor, but, given the circumstances, reduce his privilege from one that is absolute to that of a conditional privilege. Let's assume: that Durbin's "speech" comparing the actions of American soldiers to that of Pol Pot, the Nazis and the USSR's Gulag is slanderous per se; Durbin knew that it was a false statement; speech on the Senate Floor is privileged... i.e. you can't be sued for it. Is this privilege absolute, or, given the level of extreme viciousness and complete disregard to the consequences (i.e. potential U.S. battlefield deaths resulting from it) is this a conditional privilege? In other words, how absolute is absolute?

Since Pryor, Brown and Owen are "approved" as far as being filibuster proof; won't the Dems be violating their own agreement if they filibuster Saad and Meyers.........
