COLUMBIA, Tenn. - A Tennessee District Attorney told WHNT the man believed to have kidnapped 15-year-old Elizabeth Thomas could walk away with only a misdemeanor. Investigators have repeatedly said it doesn't matter if the teen willingly left with 50-year-old Tad Cummins. However, Tennessee law doesn't necessarily reflect that statement. In fact, whether or not she went willingly will play a huge role in determining whether or not the District Attorney can prove kidnapping.

Channel 4 has uncovered new information about where Thomas and Cummins were allowed to go together after they were allegedly caught kissing in a classroom.

MAURY COUNTY, Tenn. - Fifteen-year-old Elizabeth Thomas is still missing, as is her accused kidnapper Tad Cummins. Many of her family members have done interviews pleading for her safe return. Now, Kimberly Ann Thomas, Elizabeth's estranged mother is making her plea. "I can't eat. I can't sleep. I'm scared to death," says Thomas. Initially, she didn't know what to do or say. She knew her 15-year-old daughter had disappeared, and she knew some blame her for what's happened. Now she's breaking her silence.

Authorities say Tad Cummins, 50, kidnapped Elizabeth Thomas, a freshman at the high school where Cummins taught until this week. The girl is in imminent danger, they said.

NASHVILLE, Tenn.--The Tennessee Bureau of Investigation says they have received 125 leads in the search for missing teen Elizabeth Thomas and have now issued a second nationwide BOLO. TBI spokesman Josh DeVine says the leads have been "alarmingly low" and at this point the trail has "gone fairly cold." DeVine says Thomas and the former teacher she is in the custody of, Tad Cummins, could be anywhere.
