If the judge continues to ignore the fact that he’s clearly violating the law, then this will almost certainly end up fixed by an appeals court.

Well, that depends - what's the court of appeals for this case?

Sooner than later this will go the appellate court by writ. When the defendant petitions, and the plaintiff joins the petition, the judge’s improper conduct will be all the more apparent
