Why would he side with the unconstitutional taking of intangible property?

However, if she did have a mortgage that was cancelled this is a much more interesting case.

He could very well decide that she forfeited her claim to the equity by refusing to avail herself of any remedies that were available to her.

I remember when Thomas sided with the government in a case where the police obtained a suspect’s mobile phone data without a warrant. Raised all kinds of hell here on FR, but he applied the law correctly.
