Expired district court nomination under Obama

On July 30, 2015, President Barack Obama nominated Baxter to serve as a United States District Judge of the United States District Court for the Western District of Pennsylvania, to the seat vacated by Sean J. McLaughlin, who resigned on August 16, 2013.

She received a hearing before the Senate Judiciary Committee on December 9, 2015 and her nomination generated no controversy.

On January 28, 2016, her nomination was reported out of committee by voice vote. Her nomination expired on January 3, 2017, with the end of the 114th Congress.

Renomination to district court under Trump

On December 20, 2017, her renomination by President Donald Trump was announced and sent to the Senate as part of a bipartisan package of nominees which included Marilyn Horan and Chad Kenney. She was renominated to the same seat.

On February 15, 2018, the Senate Judiciary Committee reported her nomination by voice vote.

On August 28, 2018, her nomination was confirmed by voice vote. She received her judicial commission on September 10, 2018.

Didn’t we just learn that elections must be held on a single day, and any “period of time” election like week, month or season, is a violation of the Constitution?....

I know that came out last week somewhere.

What am I missing? It may have been filled out I guess too early?

You are missing the undated ballots which are filled out after election day and then mixed in with the ballots turned in by the deadline during the endless recounts.

Of course, the fraudsters could make the extra effort to post-date the "found" ballots, but why bother. The fix is in, and nobody is going to object to a 150% "voter turnout" after the Democrats win the "election".

It goes back much further than Obama. By the time he got there, most of the work was done.

The Left has always understood patronage and using government to benefit their supporters and build their power base.

The Brain dead Repub “conservatives” see it as a mark of political virtue to penalize and take away things from their own supporters.

Reminds me of the Gore team back in 2000 when they tried to get military ballots to be thrown out of the count because they lacked postmarks.

Mail-in ballots in Pennsylvania without accurate handwritten dates on their exterior envelopes must still be counted if they are received in time, a judge ruled Tuesday... Baxter said the date — which is required by state law — is irrelevant in helping elections officials decide whether the ballot was received in time...

I can see the logic in this, IF AND ONLY IF it is just the date that is missing from the outer envelope.

As long as the ballot is received prior to the deadline, it doesn't really matter what the date on the envelope says. The arrived ballot proves itself.

What am I missing with this interpretation?

According to the Supreme Court in Bush v. Gore (2000), no court has the authority to create or change election law as established by State Legislatures.

No offense, but in the context of this thread that might be the dumbest thing I’ve read.

If someone fills out a ballot after Election Day and it gets mixed in with the legitimate ones, what stops them from putting a date on the envelope?

That’s absolutely false. Even Clarence Thomas on steroids would never issue such a ruling.

State election laws are routinely scrutinized by federal courts to ensure that they comply with the Voting Rights Act.

According to the Supreme Court, lower courts do not have the authority to create new election law. By declaring that undated Mail-in ballots can be counted, that court has bypassed the State Legislature, and created a new election law. The Supreme Court in 2000 stopped the re-counts in Florida, and overturned the Florida Supreme Court's decision to allow re-counts in certain counties to occur, because that court was creating/changing existing election laws set by the State Legislature.

From Encyclopedia Britannica on Bush v. Gore: "The court ruled 5–4 on the remedy of the matter, with the majority holding that the Florida Supreme Court’s decision had created new election law—a right reserved for the state legislature."

No- When Trump makes bad picks then it is on him. He needs to have these things checked thoroughly by a good group of people. This is far from a single example. His last two USSSC picks are really bad.
