“The new Congress gets seated I believe on January 3rd.
The date Congress can nullify the EV’s is of course January 6.
So it’s not the make up of this House this session that matters when nullifying the EV’s.
I would be more concerned this session with the Democrats using their possible new majority to legislate for amnesty and/or illegals to be eligible to vote this November.”
The left doesn’t need to wait and take the risk that the House will end up with even a larger GOP majority after November. If they get one or two more to resign before the elections and take the majority, they can declare Trump an “insurrectionist” and declare him not eligible for the Presidency no matter the outcome of the November elections.
That would be like Michael Scott just declaring "backrupcy".
If they don't have the votes then so what?
Even if they do have the votes, there's still the matter of due process, the Constitution and SCOTUS.
They will also declare a bunch of GOP Representatives and Senators ineligible, including currently serving ones. They will wait until after the election to do this.
