BREAKING! Judge Arthur Engoron Under Investigation for Allegedly Receiving Unsolicited Advice Before Fining Trump $454 Million

Judge Arthur Engoron is now under investigation after claims surfaced that he received unsolicited advice from a prominent New York City real estate attorney, Adam Leitman Bailey, weeks before ordering former President Donald Trump to pay a hefty $454 million judgment.

This investigation by the New York State Commission on Judicial Conduct seeks to determine whether Engoron violated judicial conduct rules, NBC New York reported

In a legal proceeding, all parties (Plaintiff and Defendant) must be privy to any conversation about an ongoing proceeding with the Judge who is in charge of that proceeding. Otherwise it is an “ex-parte” contact which is a violation of the Code of Judicial Conduct. If a non-party person engages in an ex parte contact with a Judge where the Judge’s proceeding is discussed, that non-party person is subject to criminal charges - Tampering, Undue Influence, etc.

In this instance, he sat and listened to a lawyer unassociated with the case, who told him that the law was being mis-used in several different ways and that the case was bunk.

Interesting. From this attorney’s wikipedia page:

“Trump SoHo New York[14] is a $450 million hotel condominium. In February 2011, several prospective buyers of condominiums in the building, including French soccer star Olivier Dacourt, sued the developers in federal court, claiming that they had been tricked into buying the condos by the “deceptive” sales figures, and that the number of apartments sold at Trump Soho had been “fraudulently misrepresented.” The plaintiffs were represented by Bailey. The suit was settled with plaintiffs recovering 90 per cent of their deposits.[15][16] Several years later, the case was described as “a watershed case in the world of condo litigation ... “I actually had the ability to speak to him three weeks ago,” Bailey said, during an on-camera interview with NBC New York on Feb. 16, the day the judge’s decision was due. “I saw him in the corner [at the courthouse] and I told my client, ‘I need to go.’ And I walked over and we started talking … I wanted him to know what I think and why…I really want him to get it right.”

Bailey, who said he is no fan of Trump, was not involved in the civil case and is not connected to any of the four separate criminal cases against the former president. He said he knows the judge from having appeared before him as a litigant “hundreds of times.”

Bailey said he “explained to him” that a fraud statute at issue in the case was not intended to be used to shut down a major company, especially in a case without clear victims. He said such a ruling would hurt New York’s economy. Engoron had rejected a similar argument raised by the Trump team in court.

“He had a lot of questions, you know, about certain cases. We went over it,” Bailey said.

The sworn testimony of a disinterested officer of the court (Bailey) will, even without further evidence, be given a strong presumption of truth.

I believe Bailey’s word could well overcome a contrary statement from a facially self-interested Engoron.

Sounds interesting. But if the judge didn't solicit the advice, well then why is he being investigated?

Receiving unsolicited advice? Hardly seems like a big deal to me. I get unsolicited advice all the time. Whether I take it or not is up to me. I don’t think this case is going to amount to anything other than a distraction and it’s probably an attempt to prove that the judge makes his own decisions. He’s going to look better afterwards not worse.

Because there's no record of Engoron notifying the parties of such a discussion with Bailey.

Engoron's having declared Trump guilty before the trial began is a clear statement of his bias.

It would be interesting to know if the guy who gave unsolicited advice to the judge had received unsolicited confidential information on Trump from the IRS, etc.

It means this is meaningless.

I’m not a lawyer but I play one on TV, and I have to agree with you.

It means the judge didn’t solicit the advice, so he likely isn’t in an jeopardy at all.
The only thing I would image they are investigating is whether there there were any clandestine communications (solicitation) or a previous relationship.

Sounds like the defense was in the dark about this so called expert, and unethical for the judge to utilize him without Trumps lawyers examining him.
