Doesn’t make sense.
At the time there was talk that Congress could easily pass a special dispensation - they would have had to approve him anyway - they could have made it a rider on the approval. Now of course, that could be a huge problem depending on who the candidate was, but given the way they looooove them some Mueller, it probably would have passed.
That is a red herring. He served a couple extra years by special dispensation from Congress, and he could have easily gotten another one if Trump nominated him. The DS would have loved to have him back.
