Special Counsel Jack Smith in a court filing on Tuesday revealed the DC grand jury hearing evidence in Trump’s classified documents case has ended.

Jack Smith used a DC grand jury – and a radical Marxist Obama-appointed DC judge (Beryl Howell) in the classified docs case before quietly roving down to Florida to file the charges.

Judge Cannon demanded Jack Smith explain “the legal propriety of using an out-of-district grand jury proceeding to continue to investigate” Trump and his associates.

It is against the DOJ rules for prosecutors to present a case outside of the district where the crimes took place.

It’s interesting how the Trump side can AT BEST hope for a somewhat fair judge. Why can’t we get a “right wing hack” to dismiss all the charges in such as way that it couldn’t be reopened with not much time? See how they like when the law is irrelevant.

No. The findings of the DC grand jury were presented to the Florida grand jury and they handed down the indictments, which is why the case is being tried in Florida. The charges related to J6 are from a different grand jury in DC.

It’s way large and they are going to try to downplay it.

But it proves that the real criminal is Smith himself, a man who bends and breaks federal regulations and laws routinely to get what he wants.

Will we see the House Judiciary Committee investigating this? Maybe Mad Jack brought into the committee chambers in handcuffs, like he does to hapless “perps” who are victims of his legal swindles?

...are illegal? The DCGJ had no right to exist. Isn't that why he is filing these motions? I'm sure Smith knew this which adds a sinister twist. Did the FGJ not have legal right to access info fed to them via the DCGJ without DCGJ involvement? If they did what was the purpose of Smith doing this? Is he as daft as he looks?

Not just against DOJ rules, against the provisions of the Constitution.

It's actually a loophole in the Constitution.

The Fifth Amendment says that nobody can face a criminal trial without an indictment from a grand jury.

The Sixth amendment says that all trials are by jury, and must be held in the district where the crime occurred.

The Constitution does not say that the grand jury must be in the district where the crime occurred.

No, the findings are not illegal. There is no prohibition on having two different grand juries investigate to determine if crimes were committed in their districts. In fact, Smith could impanel another grand jury in New Jersey to investigate the issue with the Milley document that Trump allegedly shared with people at his golf course there, since that would be a crime that occurred in that district. But once Smith chose to file the charges in this case in Florida, there was no reason to keep the DC grand jury investigating these crimes unless they could identify separate related crimes that took place in DC.

I think Jack was just too afraid to call another Grand Jury in Florida. Enough has leaked out and I’m sure Jack didn’t present and explain the Presidential Records Act and the Case Law (Judicial Watch VS Clinton) to the previous Grand Jury. If he went back the Grand Jury might have started asking questions and even rescinded the previous bill.

It is true that the grand jury in DC did its job. Its true as well that the judge asked the prosecutor to explain the use of a DC grand jury some time ago.
