I would not put this down as a red herring because I don’t recall this ever going before a court before.

Also Openurmind makes some interesting points in his post #14. He thinks this is a 5th amendment issue of self incrimination but tend to think of it in the realm of the 4th.

I see the parolee’s cellphone as place to keep records which can be searched without a warrant

Even an incarcerated guilty prisoner cannot give up their own right to counsel and cannot be forced to self incriminate themselves. The 5th is set in stone and can never be compromised for any reason under any circumstance.

Well, in America's militarized "justice" system, the local cops are likely able to rent a cell in the American Gulag in DC ... and keep you there (in solitary confinement, of course) until you "confess and submit".
