Landmark Legal Foundation readies constitutional suit if Obamacare passes with Slaughter Solution

Landmark Legal Foundation president and Talk Radio powerhouse Mark Levin promised today that his foundation will file suit in federal court challenging the constitutionality of Obamacare if it is approved in the House using the Slaughter Solution.

“Landmark has already prepared a lawsuit that will be filed in federal court the moment the House acts. Such a brazen violation of the core functions of Congress simply cannot be ignored. Article I, Section 7 of the Constitution is clear respecting the manner in which a bill becomes law. Members are required to vote on this bill, not claim they did when they didn’t. The Speaker of the House and her lieutenants are temporary custodians of congressional authority. They are not empowered to do permanent violence to our Constitution," Levin said.

Even if Landmark never does another good thing for the Republic, what it has been doing for more than a decade to expose the facts about the partisan political partnership between the National Education Association and the Democratic Party makes it an invaluable asset. You can check that out here.

Landmark also has done superb work in exposing how federal bureaucrats at the EPA have funneled billions of tax dollars to radical environmental groups that lobby on behalf of more regulatory power, bigger budgets and expanded staffing for ... EPA. Check that out here.

Levin may be best known for his New York Times best-seller, "Liberty and Tyranny: A conservative manifesto." I knew something remarkable was bubbling "out there" among the American people last year when Levin's book zoomed to the top of the best-seller's list and people lined up for blocks in places like Fairfax County, Va., to buy signed copies of the book and to meet him.

They won't need the slaughter resolution, they have held a gun to the heads of the RATS and as cowards are they will just pass the bill.

If they pass this thing with the Slaughter Solution, it’s definitely worth a shot. There’s never a guarantee how a court would rule, but there is strong precedent when the SCOTUS struck down the 1996 Line Item Veto law.

The issue there was that the POTUS could not alter a bill passed by Congress, then sign it into law without another round of votes.

I think you have a similar issue here, cause the House will not have voted on the EXACT legislation that the Senate passed-this will go beyond just “how they make their own rules.”

Obviously it would be better if we killed the bill, but if they pass it, I hope it’s with this “Slaughter strategy”, cause I think there’s at least a 50/50 chance the court strikes this down-then we would have the best of all worlds-the Dems getting creamed in November AND their health care reform bill invalidated.

Just hang on and when the recording is over, you will get the Capitol operator. Just ask for your Rep or Senator’s office. Then you will either talk to an aid or have the chance to leave a message for him/her to vote NO on the health care bill.

When you use the second number and the Capitol operator comes on, just ask for your Rep or Senator’s office. Every time I use this number I get the Rep or Senator’s answer machine, so it may be set up that way all the time...to go to their answer machine. Either way you can leave a message to vote NO on the health care bill!

We need to use these toll free numbers that have been set up for the health care/ BO supporters and illegals to use! After all they are FREE!

I heard that, but I don't think I can agree. The portion of the Constitution that deals with how a bill becomes law seems to be pretty concise on how that happens. I would think that the Constitution on how a law becomes law, would trump the "Rules Committee" of whatever party was in power at the moment.

I respect The Judge, but I'm very much hoping he is wrong here. And, go Levin!

Then instead of us running on Health Care, the dems are going to run on the supposed Republican Court thwarting the will of the people. As (I think) you said, its much better if we kill this before letting Scalia have at it.

I think a far better approach would be to deem that the 'bill' wasn't a bill at all. Since it didn't follow the process laid out in the Constitution, deem that all the President had signed was a draft.

With that approach, there never was a bill so there's no need to have another bill repealing it. There would be nothing for the President to veto.

That said, the best approach is keep the pressure on congress and pray the Slaughter rule goes down in flames.
