He was too radical to get a Senate vote on his nomination to a federal court. So his consolation prize is the California Supreme Court. Jerry Brown must have felt sorry for him not getting to be a federal judge.

Liu is hardly controversial. He's a died in the wool CHICOM and when you're one of those guys there's only one side in the debate ~ or you get a bullet in the back of your head.

His nomination for this particular job demonstrates that the top end of the Democrat Party is entirely too far Left for the safety of this country.

Controversial Scholar Nominated To California Supreme Court

California Gov. Jerry Brown (D) on Tuesday nominated University of California law professor Goodwin Liu to sit on the state Supreme Court.

In announcing his pick, Brown called Liu an “extraordinary man and a distinguished legal scholar and teacher.”

Liu, 40, awaits confirmation by the Commission on Judicial Appointments. The State Bar’s Commission of Judicial Nominees Evaluation will be asked to make a non-binding recommendation to the three-member commission.

He would replace Carlos Moreno, the former associate justice who stepped down in February to enter private practice. Moreno, 62, is now of-counsel at Irell & Manella LLP, in Los Angeles.

“Goodwin Liu is a brilliant scholar and dedicated teacher. He is admired for his measured, balanced and rational judgment, and for his outstanding reputation as a fine colleague at the Berkeley School of Law,” Moreno said. “He brings his considerable intellectual depth in the law to a wonderful, precedent-setting court, along with a unabiding conviction for equal justice for all.”

Speaking against the nomination, Tom Del Beccaro, chairman of the California Republican Party, said Liu would likely be an “activist judge” who would “spread uncertainty in the legal system and employment environment.”

The state GOP leader outlined his case against Liu’s nomination in a post at Fox & Hounds Daily.

Supreme Court justices serve 12-year terms, after which point they face retention votes by the people.

Liu, professor of constitutional law at the University of California at Berkeley, was nominated by President Barack Obama (D) to join the U.S. Court of Appeals for the Ninth Circuit.

The Feb. 24 nomination was derailed in May by U.S. Senate Republicans who feared Liu would be an activist judge. A week later, Liu withdrew his nomination.

Liu has never served on the bench. The six current justices have all served in lower courts, and are appointees of Republican governors.

Liu attended Stanford University and Yale Law School. He went on to clerk for U.S. Supreme Court Justice Ruth Bader Ginsberg, appointed to the high court by President Bill Clinton (D).

Prior to joining the Berkeley faculty in 2003, Liu was an appellate litigator in the District of Columbia law office of the international law firm O’Melveny & Myers.

Liu, of Taiwanese descent, was born in Georgia and raised in Sacramento. He is married to Ann O’Leary, the founding executive director of the U.C. Berkeley Center on Health, Economic & Family Security.

To consider Brown’s nomination, as Commission on Judicial Appointments members, are Chief Justice Tani Cantil-Sakauye, Attorney General Kamala Harris (D) and Court of Appeal Justice Joan Dempsey Klein, the longest-serving presiding justice of the appellate courts.

The coalition is starting to consolidate their control-a process which will lead to an even further increase in governmental oppression. The criminal element of our society will be increasingly favored; for example, the death penalty will be going soon; tax restrictions placed by the people on the legislature will suddenly and miraculously be found unconstitutional; property will start being seized; a person defending his person and property will be subject to ruinous legal bills and perhaps criminal prosecution.

This ‘Bird of a feather’ nominee will be up for confirmation, perhaps as early as 2012. Liu needs to be resoundly thrown off the bench. Is anyone aware of the confirmation schedule when a nominee replaces a retiring justice?

I suppose I shouldn’t be surprised. Back in the day, he chose Rose Bird to be Chief Justice. Several years after one radical ruling after another, Bird was thrown off the court by acclimation.

The word ‘controversial’ caught my eye, too. I thought only conservatives were controversial.

You’d think, tho, that Brown might have learned his lesson. He saw three of his CA Supreme Court justices removed from office, including the much-reviled Rose Bird, Chief Justice.

I think Jerry Brown noticed that the people who had opposed him and his activist judges have largely moved away or died. Most of the current residents weren’t around or are too young to remember.
