The Affordable Care Act will automatically force people on Medicaid when they qualify. Affordable Care Act drops the asset test to qualify for Medicaid.

Another side effect of the ACA private insurance is too expensive for the average American to afford. Where a lot of private insurance companies are dropping people now or increasing their rates due to the requirements of the ACA. If you are not effected yet, you will be in the next year or two.

Sum it up, if you own a house, but qualify for subsidized health insurance plan and between the age 55 – 64 you will be force onto Medicaid. Depending on your state laws the government can use Estate Recovery Laws to pay back the government for your health care. You cannot pass your wealth to your children and grandchildren.

I guess this is Ok with the 99%er (aka Occupy Wall Street types). Make those rich people pay, besides they should not be able to inherit wealth. Only one problem here: The 1 percent will not be effected by this, they can afford to purchase private insurance or they are in office of high power (White House, Congress exceptions, Unions etc…).

Affordable Care Act of 2010. Estate recovery will be forced on millions of people who might have otherwise gone without insurance. Why? Because the plan is that millions more Americans have health insurance. That would be accomplished by expanding Medicaid and implementing premium assistance (subsidies). When a person is found to be eligible for Medicaid, they will be automatically enrolled into their state’s Medicaid program. Those forced into Medicaid will, due to the federal law, also be forced into estate recovery. Their estates will be partly or fully taken over by the federal or state government when they die.

Estate Recovery and Liens

State Medicaid programs must recover certain Medicaid benefits paid on behalf of a Medicaid enrollee. For individuals age 55 or older, states are required to seek recovery of payments from the individual’s estate for nursing facility services, home and community-based services, and related hospital and prescription drug services. States have the option to recover payments for all other Medicaid services provided to these individuals, except Medicare cost-sharing paid on behalf of Medicare Savings Program beneficiaries.

Under certain conditions, money remaining in a trust after a Medicaid enrollee has passed away may be used to reimburse Medicaid. States may not recover from the estate of a deceased Medicaid enrollee who is survived by a spouse, child under age 21, or blind or disabled child of any age. States are also required to establish procedures for waiving estate recovery when recovery would cause an undue hardship.

States may impose liens for Medicaid benefits incorrectly paid pursuant to a court judgment. States may also impose liens on real property during the lifetime of a Medicaid enrollee who is permanently institutionalized, except when one of the following individuals resides in the home: the spouse, child under age 21, blind or disabled child of any age, or sibling who has an equity interest in the home. The states must remove the lien when the Medicaid enrollee is discharged from the facility and returns home.

Literally every state has different laws regarding this, you have to get legal advise from a senior lawyer who specializes in the field.

Twice in my life I’ve seen families lose everything due to poor health and poor planning, quarreling family members, and Medicaid and Estate Recovery laws.

With Maryland reporting that 95%+ of all new health insurance exchange enrollees signing up for Medicaid, there are going to be large numbers of people who are going to sign up for free cheese without the faintest clue about the mousetrap.

Obama has granted many exceptions to Obama Care for his political allies. Can any lawyer on Free Republic comment how this is legal in light of the "Equal Portection Clause of the Constitution."

The clause is as below:
