Coming Up Short on Her Search

by SHANNEN W. COFFIN March 13, 2015 1:00

Mrs. Clinton’s deletion of “personal” e-mails likely violates federal records law Shortly after her press conference this week at the United Nations, Hillary Clinton released a background “Q&A” that all but confirmed that she did not comply with federal records laws (a story that Time reported on yesterday).

Mrs. Clinton’s lawyeristic backgrounder explained that, after the State Department requested the return of any e-mails that contained official business, her legal team conducted a highly suspect review of the e-mails to determine which ones might contain official business. Rather than actually reviewing each of the 60,000 or so e-mails, her legal team developed a screening mechanism, common in civil litigation, of using keyword searches to cull the stack.

The backgrounder explains that Clinton’s lawyers first searched the e-mails to see if they were sent by or to a “.gov” e-mail account, capturing any e-mails Mrs. Clinton may have sent to official federal-government contacts (but not Clinton.com e-mail accounts maintained by her close associates).

They then added as search terms the names of 100 government officials. Those names would simply have been people that Hillary Clinton might have remembered having an e-mail exchange with during her tenure in office. Finally, the lawyers added in some legal search terms, like “Libya” and “Benghazi.”

The key point:

“Here, Mrs. Clinton apparently did not have any discussions with the State Department about her search methodology and terms. And how on earth could Mrs. Clinton develop a list of all the subjects she might have sent or received e-mails about during her tenure at the State Department? The answer is that she could not. So there is every reason to think that the 30,000 e-mails Mrs. Clinton turned over to the State Department in December 2014 were under-inclusive.”

Sounds like her legal team may be in legal trouble too.

When Hillary mixed official email with personal email she abdicated the right to withhold any of them from State Dept. review.

TigersEye :" When Hillary mixed official email with personal email she abdicated the right to withhold any of them from State Dept. review."

EXACTLY TRUE !
Both the email and the server are subject to investigation.
It was her choice to use a private server , and that choice has consequences !

And also unemployment numbers were “unexpectedly” revised upwards.

Yes, because every question that now exists about her records is a direct result of her decisions alone I am sure that any honest judge would rule just as I stated. By her actions she cast doubt on every question about rules, protocols and laws. The only way to settle it is a deep forensic analysis of that server. Gotta get a subpoena for it in front of a judge.

As usual, Occam's Razor satisfactorily accounts for all of the following facts via the simplest explanation:

Here is the explanation:

Mrs. Clinton was given a harmless sinecure with maximum political visibility. While someone else actually ran the State Department, Mrs. Clinton embarked on a four-year drinking binge at the taxpayers' expense.

This is the simplest explanation which accounts for all known facts of her tenure at the Department of State.

I'd like to go further and say that the State Dept. has abdicated its right to do any review of her emails now due to their incredible incompetence in allowing two years to pass without acquiring them all as required by law.

So custody of the server needs to happen soon and it should not go to State.

You nailed it.

I'm thinking it would have been better for the US if Obama had been let loose to do nothing but play golf for eight years, but having the country run by Biden or Jarrett or Holder or pretty much anyone else in the Obama administration would not have been much of an improvement.

I’ve always said, “if you put a mophead in charge things will stay the same.” I’m starting to think we may be better with a mophead

But WHO will/can prosecute her??? Not the “Just Us” Dept. for sure....and the Congress has no power to do much. She WILL get away with it.

...including personal emails on .gov accounts.
...on State Department servers...

She admitted she didn't use the .gov account and the "personal" emails were never on State Department servers.
