Generically, an impeachment may be an inquiry into the integrity or validity of a practice, but with respect to high office holders, it seems to be an allegation or charge of official misconduct.

If Justice Roberts cast his vote under duress from the President regarding National Federation of Independent Business v. Sebelius (2012), the Affordable Care Act decision-if it might be imputed that he failed in his oath to 'defend the Constitution of the United States against all enemies…domestic', is the matter impeachable?

Roberts is a moderate Justice. I think he’s wrong sometimes, but I can understand his POV (though I think it wrong).

For THIS, and for rewriting the law which scotus does not have the power to do, he ought to be impeached and removed, if he doesnt step down when asked to resign.

I would also demand Kagan to resign for not recusing herself from ruling on obamacare after lying about it in front of scotus for the obama admin. If she does not, impeach and remove her too.

But I don’t see how Congress can remove a House-impeached Roberts from office. This is because, even after four election cycles, enough elections to have hypothetically replaced 133% of the Senate by now, low-information patriots have still secured nothing more than a lame duck Senate majority which is not enough to remove anybody from office.

But maybe Trump could find a way to pressure state sovereignty-ignoring activist justices to resign.

As to how far the court could go to interpret the law, it’s standard practice for the court to interpret a law to be constitutional if they can.
