Andy McCarthy with Levin: Mueller Should Not Be Permitted to Subpoena Trump, Nor Even Ask for Inter

On his nationally syndicated radio talk show Wednesday, host Mark Levin interviewed former federal prosecutor Andrew McCarthy on the topic of Special Counsel Robert Mueller’s threat to subpoena and interview President Donald J. Trump, McCarthy suggesting that Mueller should not be permitted to subpoena Trump, nor even ask for an interview.

“Well, I don’t think, Mark, that not only should a prosecutor not be permitted to subpoena a president by a court, I don’t think the Justice Department should allow a president to be even asked voluntarily to submit to an interview in the absence of evidence that there’s a serious crime that the president is complicit in and indication that the only way that you could get the evidence that the prosecutor can show is vital to the case is through the president,” stated former federal prosecutor Andy McCarthy on Mark Levin’s show. “So, you know, you’d have to be in like a Nixon tape situation, where you have evidence of a crime that the president’s complicit in, and the only way you can get the tape is through the president, through the White House.”

Well, this is silly. Andrew McCarthy is operating under the idea there are laws and a process. Mueller is the law and Trump is guilty. Mueller just has to find or create a crime to find Trump guilty. No trial. No evidence. No process.

It’s the new way. Trial by press mob.

And don’t worry about there being 330 million privately owned firearms in this country. I’m sure half the country won’t mind at all that their elected President was railroaded out of office on fake pretense generated by the political opposition and aided and abetted by the FBI. That’s all perfectly fine. Don’t worry.

Before we turn first to leaking, some disclosure. I am fond of Jim Comey and have been for 30 years. I vigorously disagree with both his handling of the Clinton emails investigation and the manner in which the FBI has conducted what is supposed to be a classified, counterintelligence probe of Russia’s interference in the 2016 election — not a public, government-orchestrated campaign of insinuation that Trump was complicit in Russian perfidy.

No doubt because of my personal regard for him and respect for his high-end ability, I am inclined to cut the former director slack. He was thrust into a no-win situation: It is not his fault that Democrats nominated a criminal suspect, or that Republicans nominated an irregular politician heedless of the norms of discretion and distance that a president should maintain when dealing with his law-enforcement subordinates. Comey aside, I had no better friends in nearly 20 years as a federal prosecutor in New York than Dan Richman, the Columbia Law School prof through whom Comey transmitted information to the New York Times, and Pat Fitzgerald and Dave Kelley, Comey’s lawyers [and yada yada yada]....

I think there should be a wire tap placed on FBI Mueller, and hire 12 experts to go after everyone that he has talked to for the last 12 years. I think we can find something.

Are you kidding? The FBI breaks the “law”, every single day. They boast about it. They revel in their criminality. They pick a target, immobilize it. Go after it. Create a crime and use the hundreds of thousands of “laws” on the books to charge and seek prosecution of the “crimes”. But, they are “government”, so their “crimes” aren’t REALLY “crimes”. It’s just ‘bidness’.

No. There’s not. On our side, too.

I will NEVER forgive these demented bastards for acting like this for the past year and a half. I tried to reason with my idiot brother yesterday (who has called Trump “the most vile person in history”) and asked if he thought it was reasonable that they just keep attacking him with no evidence of any crime. “Yes, because he deserves it.” So there you have it. To these idiots, Trump is the enemy and ANYTHING goes because he’s the enemy, and THAT’S IT. No more thinking allowed. No more reasoning needed.

I don’t know where we go from here. The two sides are not going to come together and do not want to come together.

Robert Mueller has a long and sordid history of illicitly targeting innocent people. His many actions are a stain upon the legacy of American jurisprudence. He lacks the judgment and credibility to lead the prosecution of anyone.
I do not make these statements lightly. Each time I prepared to question Mueller during Congressional hearings, the more concerned I became about his ethics and behavior. As I went back to begin compiling all of that information in order to recount personal interactions with Mueller, the more clearly the big picture began to come into focus.

This article is prepared from my viewpoint to help better inform the reader about the Special Prosecutor leading the effort to railroad President Donald J. Trump through whatever manufactured charge he can allege.

Judging by Mueller’s history, it doesn’t matter who he has to threaten, harass, prosecute or bankrupt to get to allege something or, for that matter, anything. It certainly appears Mueller will do whatever it takes to bring down his target — ethically or unethically — based on my findings.

Let’s look at what we know. What I have accumulated here is absolutely shocking upon the realization that Mueller’s disreputable, twisted history speaks to the character of the man placed in a position to attempt to legalize a coup against a lawfully-elected President...

Absence of evidence of a serious crime

No collusion, no scheming with Russia to corrupt the US election - at least by Trump

Either turn the investigation into Hillary collusion with Russia by accepting fat fees for favors and to avoid blackmail

Or End it

We already did. Uranium One. As much as I like Giuliani, what he needs to do is meet with Mueller and simply say “we have all the evidence that you committed illegal acts with Uranium One. Investigation ends today or we subpoena you to go in front of congress to testify about it. Oh, by the way, we have a grand jury ready to go.”

McCarthy is giving perfect advice with flawless reasoning behind it. He lays it all out, no holes, and there is no excuse for not following it to the letter.

If Sessions and Rosenstein are “good guys,” they will state publically they will not allow Trump to be interviewed with no stated underlying significant crime.

(As McCarthy states, campaign finance stormy violation theories are nebulous at best, and not worthy of a POTUS interview.)

This will be solid evidence which side Sessions and Rosenstein are on. Proof positive.

Place your bets.

So what to do? Should one side kill off all the others? Not a good idea. There will always be two sides, perhaps more, to ANY conflict or disagreement. Definitely a compromise is needed.

Obviously, one side killing off the other would not be a good solution.

For me, compromise is not a workable solution, either. Compromising with a leftist means you give them what they want and shut up. In this climate, it’s utterly impossible because they are not going to stop and not going to give an inch. Never.

Everyone is afraid where this is going because there’s no peaceable solution in sight. What’s going to happen if they manage to remove our President? Do they even think that far ahead? Do they even care?

We could break the country up - give them California and let them build their sexless liberal utopia - but that would just be putting off the problem, because they’d still hate us, and then start demanding that we support them when their little utopia falls apart because, after all, children can’t run countries.
