Why when Neil Gorsuch became one of the Supremes, didn't he have any chance of becoming 'The Swing Vote'?
And, does Kennedy's replacement, automatically become the Swinger?
Or does some other, standing Justice assume that mantle?
because he is inconsistent, and therefore unreliable.
He was the swing vote because he was conservative on some issues and liberal on others.
Kennedy is liberal on some social issues, but more conservative on other issues.

This is a fun thread to read at Dummyunderground.
The libs seem to forget, Kennedy was appointed by Reagan.
The “Swing Vote” isn’t an official position. It’s a behavior.
Kennedy was a swing vote. He voted according to what seemed popular at the moment, rather than according to The Constitution as his oath demanded.
Kennedy is pro-gay and pro-abortion, for example.
Currently the Court has 2 conservatives, 2 moderates 1 liberal (Kennedy), and 4 feudalists.
As a true liberal Kennedy was the only one who could occasionally err and agree with the feudalists to do something “good” even though the Constitution did not give the Court the power.
Swing vote. Schwing vote.
Past history. When decisions come down as 6-3 (conservative) we’ll all be better off.
Pandora Kennedy’s legacy is that he gave the pervs power through his judicial activism, they over-reached by attacking free speech, and he has been trying to undo it since.
8 justices have the pattern of staying on one side of the fence or the other, conservative and liberal. Kennedy goes both ways. If another conservative gore son, then Roberts will be a “swing vote.”
He likes the cachet of being the deciding vote. He gets his fifteen minutes over and over again.
Swing vote refers to a moderate position of both sides and can be essentially a coin toss on some matters.
Gorsuch couldn’t be the swing vote because he is entirely reliable on most issues...
also Kennedy and RBG have both declared they consider international law when interpreting the US constitution and rendering opinions.
Kagan may be moving to the swing slot.
Kennedy was a swing vote because he seemed inconsistent in his rulings. He was the vote that gave us gay marriage, but he ruled this week in favor of more freedom, less government interference. ..he was often unpredictable.
The only one on the present court I can see being a swing vote is Roberts. Obamacare wasn’t the only mistake he’s made. But thatsrjust a cynical guess.
If the apostate black-robed tyrant kennedy is replaced with an actual, honest judge, there will be fewer cases where there would be a swing. It will be more common to know before a case is decided what the outcome will be, as instead of a breakdown of 4 humans, 4 demons, and 1 idiot, the Court will comprise 5 humans and 4 demons.
If demon Ginsburg gets recalled by its master (age 85, and not in good health), and/or demon breyer buys the farm (age 81) during Trump’s term, we could wind up with a 7 human - 2 demon Court.
LOL! Thanks for linking
Some of the most recent unreliable Judges were appointed by Republicans: Stevens, O’Connor, Souter, Kennedy, Roberts.
There is always the chance that any nominee may have a screw loose like Kennedy, Souter and others have demonstrated in the past.
It’s a lifetime appointment, so it’s better to be careful in your selection.
