Judge Who Attempted to Sanction Obama Eligibility Attorney on List of Supreme Court Nominees

On Wednesday’s “Hannity” opening monologue, a list of judges on President Trump’s list to replace retiring Associate Justice Anthony Kennedy was presented in a fast-running backdrop. A complete list can be found here.

Kennedy’s retirement, announced earlier on Wednesday, immediately spurred discussion as to who Trump might nominate to his seat. Constitutionally, all potential cabinet members and federal court nominees must be confirmed by a majority of the U.S. Senate.

The Senate currently consists of 51 Republicans, 47 Democrats, and two Independents. In November, one-third of the chamber will face re-election or replacement.

Sen. John McCain (R-AZ) is unlikely to cast a vote, as he has been absent from the Senate for several months due to serious illness.

At present, minus Kennedy, the Supreme Court contains what many view as four “liberal” justices and four “conservative” justices. Kennedy was often referred to as “the swing vote,” as the way he would opine on any given issue could not always be discerned in advance.

Early last year, Trump nominated Tenth Circuit Court of Appeals Justice Neil Gorsuch to the high court. Gorsuch’s seating has been touted by Trump as one of his greatest accomplishments thus far.

One of the names on the list is Sen. Mike Lee (R) of Utah, another is Thomas Hardiman, who was reportedly on Trump’s “short list” of contenders when Gorsuch was chosen.

Hardiman currently sits on the Third Circuit Court of Appeals and was one of a three-judge panel which rejected as “frivolous” an appeal in a case dealing with the issue of presidential eligibility stemming from the election of Barack Hussein Obama in 2008.

The appeal, submitted by plaintiffs’ attorney Mario Apuzzo of New Jersey, consisted of a 95-page brief challenging a lower court’s finding that the question of presidential eligibility is a “political” one.

Here is my pick:

Amy Coney Barrett of Indiana, U.S. Court of Appeals for the 7th Circuit

Barrett, age 46, a former University of Notre Dame law professor, was nominated to the appeals court by Trump and confirmed by the Senate in October 2017. Some Democrats questioned her about her Catholic beliefs. She is a former law clerk for the late Supreme Court Justice Antonin Scalia.

She is younger than all the others, clerked for Scalia, is a member of the Federalist Society, survived the attempts to smear her when Trump nominated her in 2017.

AND the Dims will just HATE Trump of all people nominates a “female” judge that is not one of theirs.

Federalist who clerked for Scalia - Win
Young (youngest of all on Trump’s list) - Win
And the Dims will hate her - Win, Win, Win

Lee is not a viable candidate for this vacancy precisely because his views on abortion are well known (and FTR I fully agree with them). Thanks to what has been fittingly described as our “own goal” in Alabama we have a Senate majority of exactly 1. That means we can afford to lose only one vote. But there are two GOP Senators (both women) who are at least moderately pro-abortion. I doubt either would vote for a candidate who was openly declared to support overturning Roe. Whoever is nominated to fill this particular seat must be someone who, whatever they may have said privately, is not on record on this subject. Political pragmatism sometimes is uncomfortable but we need to give them both some plausible deniability in exchange for what will likely be difficult votes.

Good choice, I’m thinking Diane Sykes. A little more non-traditional, and not as young, but seems pretty solid. I do agree that he might really need to play a little bit of identity politics and go with a woman on this one. The abortion issue is going to be hotter than the surface of the sun, and a female pick would certainly help throw just a tad bit of cold water on that.

Who on this list is strongest on citizenship, from a Constitutional strict constructionist point of view, as well as national sovereignty and international law regarding migration? That’s where trouble lies ahead with very few in place to deal with it in a manner benefitting US citizens.

Oh, and since they seem to be playing the identity lottery we need a Protestant Christian fundamentalist in order to truly look like the populace. Gorsuch is Episcopalian which gives me pause.

He is holding out until after the AZ Governor Primary. Ducey should win unless he appoints Cindy to replace McTraitor. Once Ducey wins the Primary McCain steps aside and his Rat wife takes his seat.
