That’s what I think. But it’s a risky proposition. If it’s a misjudgment, then we’ve traded Kennedy for a liberal. One alternative would be to go with one of the others who’s more confirmable, and put Barrett up next time if we can expand our control of the Senate.

That would be the safe play, but no matter who is nominated the rats will go all in to stop them. In this environment I think Barrett has the best chance of being confirmed. Plus she is by all accounts the type of judge Trump wants on the Supreme Court. A textulist in the mode of Scilia. I like her and I like Kavanaugh. The others I worry about.
