Kavanaugh’s Confirmation - If he is not confirmed by Monday the SCOTUS goes on without him

Just to state the obvious never mentioned fact throughout this entire process - If Judge Kavanaugh is not voted onto the SCOTUS by Monday when it goes into session, he will not sit in robes as the 9th Degree, or swaying vote.

Our National News analysis has failed to state the obvious reason for democrats demanding any delay for any reason is that they assume he will be confirmed, or that Trump will get confirmed another judge, but keeping him out of the SCOTUS by Monday keeps him from making landmark decisions that hurt the DNC agenda.

He will be confirmed.

What’s left to be done is Rosenstein and FISAgate. This whole episode of Kavanaugh is tied to it.

That has been debunked here so many times it's gotten tiresome.

Kavanaugh can issue a ruling on any case as long as he hears the oral arguments.

The October Supreme Court calendar is filled with a bunch of cases that don't have landmark implications. And even if they did, the Court can always go back if necessary and schedule a second round of oral arguments just to make sure they don't have a landmark case end in a 4-4 vote.

if he’s confirmed later, he will still be able to take the seat...he just can’t rule on anything that comes up BEFORE he sits...

This not correct, imho. They won’t wait for him, true, but Gorsuch joined proceedings the next day, recusing on some cases of which he was not fully involved.

Have Roberts appoint him as temporary clerk starting Monday so he can attend all the arguments and conferences until he is formally sworn in.

Release the unredacted docs and all associated material first. They will expose lots of new information and investigative leads to research. It will be a gold mine.

Then deal with Rosenweasel.

Yes, you’re right. It’s not 100% correct.

But it doesn’t matter as McConnell will ram through the confirmation tomorrow or Saturday.

Stepping back, what we have witnessed is the GOP becoming Trump’s party. Senator Graham’s riveting remarks today show the GOP is becoming Trumpified. I think they are finally beginning to see that Trumpism works.

I would hope that’s only the beginning of what is left to be done. The swamp is large and the drainer and chief has been tasked to drain it clean it and never let it return.

Assuming he's confirmed later, he will still sit on the Court and will only be disqualified from voting on cases that were argued before his confirmation. I don't think there are any landmark cases scheduled to be argued in the first few weeks of the Court's term.
