Gorsuch and Kavanagh both understand what “within the jurisdiction” means. This DO gets the challenge going without having to get the COM to do the paperwork. The left will immediately run to court and an activist judge will issue an injunction and then we will be on the way to SCOTUS.

Are they really subject to the “jurisdiction thereof”. They have no regard for our laws, otherwise they would enter LEGALLY.

I was talking with someone whose parents were resident aliens. She was born here and is able to vote. All this needs to be clarified.

The issue of birthright citizenship does not apply to unborn children of illegal alien mothers.

Nothing relating to birth applies to any unborn child. But every born person is subject to US jurisdiction once they enter the US. Since there is no way to be unborn, jurisdiction is established during birth.

The Fake News is so fake. Just now listening to the ABC radio news report at the top of the hour and the reporter authoritatively reports, as if slam-dunk countering Trump’s plan as she just reported, states that the Constitution states...minus the “subject to the jurisdiction thereof” phrase.

Not at all , you forgot the part of the 14th that says “and under the jurisdiction thereof” the illegals born here are under jurisdiction of the mother’s home country. Congress can change this anytime they wish..nothing to do with any amendment change, I’m not sure about an EO but I’m damned happy if he goes for it... Let the supremes decide

OK, here’s a question for you.

You claim Mexican nationals here illegally are not “under the jurisdiction of the United States”.

There are 22,097 Mexican nationals in US Federal prisons.

Suppose the Mexican ambassador goes into Federal court and applies for a writ of habeas corpus to release all 22,097 for lack of jurisdiction.

Would you support him?

And, by the way, it doesn't say "under the jurisdiction of", it says "subject to the jurisdiction of".

Those don't mean the same thing.

"Under US jurisdiction" means, someone who belongs to us.

"Subject to" US jurisdiction means someone who the US has the right to exercise compulsion on.

Sorry, but I agree with Ryan and Grassley. The Constitution has to be amended to fix this problem, or, better yet, XIV has to be repealed since all former slaves have died and it is no longer necessary.

If nothing else, POTUS will get the issue before the U.S. Supreme Court and that’s a good thing. It needs to be. Plus, he’s going to educate a ton of Americans on the issue in the meantime.

Agreed. A baseless decision back to the 19th century and a misguided footnote in the 20th century shouldn’t be enough to undo the clear language and intent on this fundamental issue.
