My Exciting Trip to the Liquor Store in Fascist Canada (new drinking/driving laws)

As I wrote in an earlier article, new laws concerning drinking and driving came into effect in Canada on Dec. 18. As well as increased penalties, cops no longer have to have a “reasonable suspicion” that a driver has been drinking before demanding that driver provide suitable breath samples.

As well, a police officer can demand someone provide breath samples if that person has driven anytime within the previous two hours. If the demand is made to a person drinking at home or in a bar and that person blows over the legal limit, he or she can be charged. It is up to them to prove that they were not impaired when they last drove.

I also wrote about Art Lightowler, a 70-year-old Ontario resident who, on Jan. 5, decided to take three cases of empties back to his local beer store to get a refund. His dastardly act of taking that many bottles back at one time caught the attention of a police officer. The officer decided Lightowler was a drinker. After the senior drove away from the store, he was stopped by the cop. The officer demanded samples of his breath; there was no evidence he had been drinking but police no longer need that. A shocked Lightowler blew into the roadside breathalyzer, passed and was allowed to go on his way. (Canada Free Press, Jan. 16)

Liquor stores should install breathalyzers and allow people to voluntarily document that they were alcohol-free at the time of purchase.

That would really piss off the judges and lawyers and LEOs.

Most likely the prosecutor would question the accuracy of the liquor stores breathalizer solely for the reason it isn’t the brand that their police force endorses.

Would be good legal “insurance” for both customers and the stores.

I haven’t had a drink for 4 years due to a health scare, but I did have a DUI back in ‘92.

So, from what I hear, they wouldn’t let me in anyway.

I thought maybe one of the new drinking/driving laws was that while you could purchase liquor at a store, you would not be able to transport it in your car at all, even if it had never been opened. It just seemed to me that a law like that would be something Canada would come up with.

If you stop on the way home from work and buy a bottle you have to wait two hours before you open it.

Nice.

So, how do they prove that you have driven in the last two hours.

More important how do you prove that you haven’t.

And Canadians would be well advised not to drink on their front porches anymore. Some storm trooper passing by might just decide to test you.

I have no plans to ever return to Canada and based on the following, all alcohol serving establishments/stores should be shuttered...

These are the penalties now:

First offence, with blood alcohol content of 80-119 mg: mandatory minimum $1,000 fine

First offence, with blood alcohol content of 120-159 mg: mandatory minimum $1,500 fine

First offence, with blood alcohol content of 160 mg or more: mandatory minimum $2,500 fine

First offence, but refuse to be tested: mandatory minimum $2,000 fine

Second offence: mandatory minimum 30 days imprisonment
Third or more offence: mandatory minimum 120 days imprisonment

Maximum penalties for impaired driving causing no bodily harm or death: summary conviction carries two years less a day imprisonment, indictment carries 10 years imprisonment

Maximum penalties for impaired driving causing bodily harm: Summary conviction for less severe injuries carries two years less a day imprisonment, indictment carries 14 years imprisonment

Maximum penalty impaired driving causing death: life imprisonment

If you have a DUI on your record Canada may not let you in. You have to formally beg.

Didnt surprise me one bit. Originally from Vancouver, ALL liquor stores are owned by the GUBMINT’.

Truly draconian. Every staff and clerk are unionized so Americans are wondering why a 6-pack of Bud costs $12? To pay these unionized staff who make close to $20 per hour.

And this is why for the past 40 years, Canadians cross the border to buy booze in the border cities which is cheaper. Trump recently raised the amount for the new US NAFTA so canucks wont pay that much duties. Either way, the border patrol are total assholes so they will make your life a living hell if you ever get caught.

“This is a radical departure from previous law, which insulated people against warrantless searches without probable cause,” he said.

Civil rights organizations have also sounded alarms about the new rules, with the Canadian Civil Liberties Association expressing concern that mandatory alcohol screening will unfairly affect racial minorities who are disproportionately singled out by cops for traffic stops.
