Nick Koumalatsos - MY BUSINESS WAS RAIDED BY THE POLICE
Youtube ^ | 5/19/2020 | Nick Koumalatsos

Posted on 05/23/2020 10:54:30 AM PDT by srmanuel

This video got me very angry and upset.

If you don't know who Nick Koumalatsos is, he's one bad ass Marine, who was in Marine Corp Special Operations as a Raider, he served multiple tours in Iraq and Afghanistan....

Search for his name with google and youtube he's been on many podcasts with other special operators about their wartime experiences.

Now out of the military he opened a gym in North Carolina and recently had a very bad experience with the local police.

In the video Nick Koumalatsos posted, someone else posted his encounter with the local police on the first occasion, the Police Captain that showed up was exercising his perceived authority and IMO was attempting to goad Nick Koumalatsos, who fortunately held his temper because you know if he had snapped that cop would be no match....

Trying to settle things down, the Chief of Police above the Captain ultimately got removed from his job, Nick's business is closed and he's trying to lead a peaceful civil protest to get his business back and rights restored.....

If this situation at the gym and around the country doesn't turn around really soon, bad things will begin to happen....if it does begin to happen people like Nick Koumalatsos are on the side of the good guys...

He's asked people to share the video and I have .

All of this is so wrong. The government in some states has gone nuts.

The weird thing is that the mayor of this town quit and the present mayor was not elected. The chief of police was removed and his replacement is this mini-cop currently pestering the owner. People need to sue under “right to assembly.”

This guy needs to sue for unlawful entry and harassment under color of office.

DEPRIVATION OF RIGHTS UNDER COLOR OF LAW
SUMMARY:
Section 242 of Title 18 makes it a crime for a person acting under color of any law to willfully deprive a person of a right or privilege protected by the Constitution or laws of the United States.
For the purpose of Section 242, acts under “color of law” include acts not only done by federal, state, or local officials within their lawful authority, but also acts done beyond the bounds of that official’s lawful authority, if the acts are done while the official is purporting to or pretending to act in the performance of his/her official duties. Persons acting under color of law within the meaning of this statute include police officers, prisons guards and other law enforcement officials, as well as judges, care providers in public health facilities, and others who are acting as public officials. It is not necessary that the crime be motivated by animus toward the race, color, religion, sex, handicap, familial status or national origin of the victim.

The offense is punishable by a range of imprisonment up to a life term, or the death penalty, depending upon the circumstances of the crime, and the resulting injury, if any.

TITLE 18, U.S.C., SECTION 242

Whoever, under color of any law, statute, ordinance, regulation, or custom, willfully subjects any person in any State, Territory, Commonwealth, Possession, or District to the deprivation of any rights, privileges, or immunities secured or protected by the Constitution or laws of the United States, ... shall be fined under this title or imprisoned not more than one year, or both; and if bodily injury results from the acts committed in violation of this section or if such acts include the use, attempted use, or threatened use of a dangerous weapon, explosives, or fire, shall be fined under this title or imprisoned not more than ten years, or both; and if death results from the acts committed in violation of this section or if such acts include kidnapping or an attempt to kidnap, aggravated sexual abuse, or an attempt to commit aggravated sexual abuse, or an attempt to kill, shall be fined under this title, or imprisoned for any term of years or for life, or both, or may be sentenced to death.

Citizens must have the courage to overwhelm these tyrants and their puppets!

Note: the Mayor or Town Council fired the Police Chief who refused to enforce their unlawful order. The Captain was too cowardly to follow the Chief's lead.

Here's a little intro for a speech the Chief might have given before the SHTF:

"I refuse to be the instrument of tyranny, by enforcing unconstitutional orders."

"I refuse to be the gestapo for those who would deny our freedoms."

"I would hope that each of you would have the courage to do the same."

Yep. The government has become drunk with power and has no plans on giving any of it back.

We have learned from the covid “plandemic” that:
1. Politicians have no problem issuing unconstitutional edicts.
2. Many cops have no problem enforcing unconstitutional laws unquestioningly.
3. Many politicians, especially in blue states and counties, have no intention of giving you your rights back. You will have t take them back.

I’m looking forward to the day when merchants refuse to sell anything to these gung-ho, lock-em-up Stasi officers and to anybody in their extended family.

No shirt, no shoes, no supporters of tyrants.

Just following the crime chiefs orders.

This is where significant rubber actually hits the road of freedom. The "chief" in this instance is the governor of NC, and a Nuremberg defense has no place in this setting.

The citizens in NC have allowed their political representatives to grant the governor the statutory authority to exercise certain police powers at certain unusual times, or they haven't. If the governor has those powers they either have, or have not been properly exercised. Likewise, if such statutes are in place, the suspended Chief and his replacement were either acting in accordance of those statutes or they were not

Is there room in "our nation of laws" scheme to allow lesser municipal authorities the right to ignore higher authority because its directives may be believed to be unconstitutional? What if a Chief of Police decides a protesting group's initiation of physical force during a demonstration is simply part of the group's "constitutional freedom of speech" and directs his people to take no action?

The national lockdowns and other measures have demonstrated to many voters just what authoritarian government along with petty, unqualified officials and their handmaiden, Zero Tolerance, looks like.

Our nation is based, however, on resolving such matters via the courts. The courts in many states are presently looking at cv19-related suits and some have already found governors lacked authority for their actions.

As a physical fitness buff and gym rat, I would almost certainly enjoy being a member of Nick's gym and I wish him good fortune.
