The one judge that dissented can ask for a full court and that court has a Dem majority (via appointments).

Twitter accounts are pushing messages asking the DC Appeals to go en banc. They need six judges to approve. The Appeals court is majority Dem appointees.

Hopefully Sullivan will sign the writ quickly before this goes on another few months.

I want to clarify that the only thing that can stop this is an en banc or full hearing of the court. That’s the next thing to watch. Expect to see Team Obama put up the bat signal trying to get one of the DC judges to ask for one...

A friendly reminder that any active judge on the D.C. Circuit can ask the full Court of Appeals to vote whether to rehear a panel decision “sua sponte”—that is, even without any party formally petitioning for such an “en banc” rehearing.

Sullivan won’t ask for an en banc hearing. He has been smacked on the pee pee and he won’t want to get further embarrassed. He was praised by Judge Henderson, so he’ll take that and go back to letting his clerks running his court and enjoying his corrupt livestyle among the Lefties.

I could be wrong, but I really don’t think so in this case.

when any righteous, ethical judge would have tossed it out of court in a summary judgment in 2018.

(a)There's no such thing as summary judgment in criminal cases.

(b) Flynn never moved for dismissal in 2018; he pleaded guilty (twice, both times under oath).

Until he gets a Presidential Pardon, he has a lot potentially hanging over his head. And even that won’t protect him from potential state charges he could face
