Despite what Biden claimed, Obama’s nominee was not brought up for a vote in 2016 because that was his last year in office, the year he nominated Garland, and no president has had his nominee approved under that scenario with an opposition party controlling the Senate since the 1800’s and Republicans controlled the Senate in 2016.

This is not currently the case for Trump as the President and majority Senate are now of the same party. Therefore Trump gets his pick and Obama doesn’t! That’s how it works!

I don’t recall anything in the Constitution about a SCJ’s wishes when it comes to being replaced.

Lindsay is in.

As to my view of filling a Supreme Court vacancy in 2020, I’d encourage you to review these most recent statements.

NBC News https://www.nbcnews.com/politics/supreme-court/democrats-warn-gop-don-t-fill-supreme-court-vacancy-2020-n1234885"

Sen. Lindsey Graham, R-S.C., chairman of the Judiciary Committee, which reviews Supreme Court nominations, said he's prepared to advance a nominee if a vacancy occurs this year.

"Yeah. We'll cross that bridge. After [Brett] Kavanaugh, the rules have changed as far as I'm concerned," he told reporters, citing the intense battle over Trump's most recent Supreme Court nominee in 2018, who was narrowly confirmed. "We'll see what the market will bear if that ever happens."
