A long and sordid history of crowds threatening violence in event of jury acquittal
Gatestone Institute ^ | April 25, 2021 | Alan Dershowitz

Posted on 04/25/2021 10:56:32 AM PDT by Marchmain

Oliver Wendell Holmes correctly pointed out: due process simply cannot be achieved for any defendant in the presence of hostile crowds ready for violence if a verdict of not guilty is rendered.

The ACLU, if the shoe were on the other foot, would be demanding a new trial — if the defendant were black, and white crowds were demanding a conviction or else. But the ACLU is no longer a neutral civil liberties organization. It has become a partisan claque that espoused due process for "me but not for thee." Real civil libertarians, who demand due process for all, including guilty police officers, must now take over where the ACLU has left off.

Whether guilty or not, Chauvin must be given a new trial at which the jury is sequestered, as it should have been from the beginning of this one. As an alternate juror candidly acknowledged, she had "mixed feelings" about jury duty, because of concerns about "disappointing" either side and the possibility of "rioting." There is no reason to believe that the unsequestered jurors who actually decided the fate of Chauvin were oblivious to this concern.

I doubt very much that the appeals process will go any better than the actual kangaroo court process we just witnessed.

The big difference now is these leftist nut balls actually threaten people your news people - at their own house!!

Furthermore they get their minions to go out and to try to destroy them on every social media that they can find - personally destroy them !

Clearly the same is true for judges and this is exactly why the supreme court clocked out and didn’t even take up the Pennsylvania case they were terrified that these leftist mobs when they found on the fax would come in terrorize them and/or kill them

What is the solution to this crisis?

Guns

and not letting children get out of control like they do

For the most part these leftist activist morons are college-age students they’re idiots and they will run so fast at the first sign of trouble it’ll make your head spin

I don’t see it as a problem there is conservatives are not likely to get out in the streets and try to do battle with morons

Nothing could be gained from that

Remember that a lot of these kids are on drugs and are extremely stupid and agitated ; and so it’s really not worth your time interacting with them

I went to Berkeley ; I’ve lived in the bay area 30 years now ; I know exactly what I’m talking about

Yeah why don’t we have the same problems here as they do in Seattle and Portland? With these leftist morons?

First of all the weather is much better. The weather in the Bay Area is almost perfect. Sunny and 70 with no humidity every day

Portland and Seattle are dreary and rainy all the time. It’s depressing

San Francisco is a bizarre and lost cause I won’t even discuss San Francisco. But the fact is the downtown is $1 billion buildings and is a complete fortress

Oakland is where the action is traditionally been at and they do have protest and what not but they don’t destroy property because it’s at 8085% black city and they’re smart enough not to destroy their fellow black friends businesses

Furthermore it is much is Oakland is just across the bay from San Francisco billions and billions and billions of dollars and then pouring in that city and downtown is a bunch of billion dollar buildings now as well

You really can’t attack billion dollar buildings

So for the most part the leftists can just burn themselves out

that’s my opinion

There is never an end of stupid children to fill in the ranks

If the media covers the appeals like they did the trial then he will die in prison no matter how long he lives. He may have done something wrong but not the murder he was convicted of.

Chauvin should have just delayed the trial for five years.

I would very much like to read Professor Dershowitz take on our criminal ‘justice’ system charging protocols; i.e. prosecutors charge 2nd degree murder, 3rd degree murder, 2nd degree homicide. If we don’t get him on murder2 we’ll get him on murder3 or if not, then homicide 2.
Is this not triple jeopardy ?

What’s the difference between that and a lynch mob?

They should have moved the trial outside of Minneapolis. When the British soldiers accused in the Boston Massacre were tried, none of the jurors were Boston residents. We can't meet the standards of 1770.

At this point, any jury is likely to have the same fear of not coming up with the "right" verdict as the first jury did.

“But the ACLU is no longer a neutral civil liberties organization.”

Seriously? It wasn’t a neutral civil liberties organization to begin with. It was specifically created to bust Communists out of jail via a perverted version of the Bill of Rights.
