Gun rights group sues California city over liability law

A gun rights group and a gun owner have filed a lawsuit against a California city for a newly passed ordinance requiring citizens to obtain firearm liability insurance and pay an annual fee.

The National Association for Gun Rights and a local gun owner sued the city in federal court Tuesday after City Council members voted to approve the ordinance believed to be the first measure of its kind in the United States.

An attorney representing the plaintiffs said Wednesday the law is unconstitutional and infringes on both the First and Second Amendments.

San Jose Mayor Sam Liccardo said that having liability insurance would encourage people to have gun safes, install trigger locks and take gun safety classes.

This idiot Mayer doesn’t understand.

CA law states Safes are required by law. Trigger locks are required to be sold with each gun unless you sign a waiver stating you own a safe. You need a “firearms safety Certificate” to purchase a gun in CA. This is a basic safety class, and at least in 2015, they forced all people who didn’t have an existing cert to go through the class to obtain one.

This is backdoor registration as by requiring this; when CA forces Private insurance out, like they’re trying to do right now, they’ll know exactly who has guns, as if they’re not already storing DROS Records.

I wrote a column for the No. Virginia journal papers in the 1980s advocating that all guns be sold with a gun lock. I had visited a gun shop just to see what it was like, and since I had two very young children, I wanted my weapon to be locked with only me and my wife having access to the key for this great $10 clamp-on device.

Still have it.

A little common sense by all can save innocent lives, esp. Of our children. I taught my kids how to safely handle a weapon, one worked at a shooting range and learned gun safety.

My son became an Army sharpshooter and killed enemy snipers and terrorists in Iraq, saving the lives of his men and of innocent Iraqi women & children the Iraqi Federer were using as human shields when attacking our troops. He later became a federal police officer .

We all still particle weapons safety, voluntarily and smartly.

Using this logic...if you just had butcher knives in the house, or a baseball bat....you ought to have liability insurance as well.

After the 9th circus upholds it, it will got to the SCOTUS where it will be struck down. Its obviously and blatantly unconstitutional. What other constitutional rights are taxed? "The power to tax is the power to destroy". Mcullough vs Maryland

Why do you think the Supreme Court will hear it?

They only hear 2-4% of cases which apply to be heard.

In the last decade they refused to hear nearly all Second Amendment cases.

because even with Roberts, a 5-4 majority will be looking to uphold gun rights. That's a dividend of replacing RBG.

No different from the poll taxes the Democrats imposed to keep blacks from voting. Impeding a fundamental civil right by imposing a fee is unconstitutional.
