A big strong professional law enforcement officer like Mr Byrd could’ve pulled all 102 lbs of her through the window and put cuffs on her. There was no way in hell lethal force at such close range was required.
Yeah a warning against what though? She was stuck in a window and wasn’t doing anything that needed a warning shot. No reason to fire any weapons at all. She was easily vulnerable to be taken into custody, but the cops around there were essentially letting the crowd be there.
Looking at the video of the shot I would surmise that it was a thought out action. I suspect the shooter had instructions to “shoot somebody,” because some capital violence was needed for the narrative.
Its also a 42 USC 1983 offense - violation of civil rights under the color of law/authority.
There was zero justification for the use of deadly force. There was no deadly or substantial threat, and Byrd admits he was confused, couldn’t see, and didn’t even know who or what he was shooting at. At an absolute MINIMUM it was GROSS NEGLIGENCE, but since the photo evidence shows he had an itchy trigger finger, he was intending on shooting someone, anyone. He was terrified. He is not, and was not, good LEO material
The shooter did not look to be protecting anyone from anything. At best he was “protecting” someone who might have been further inside the building and who might possibly have been in danger of being spoken to offensively.
This guy's an idiot. Someone tasked with protecting an official looks at potential harm to the person he's protecting, not himself.
The guy only applies the standard to Bryd's life because, there was nobody else near Bryd! The hallway that Bryd was defending, was empty. Nobody else was about to be killed or injured.

I suspect that the expert is a little more of an expert than you are. At the moment of the shooting there is no one but police officers and protestors at the scene. Two other heavily armed officers standing with the crowd are not concerned enough to even raise their weapons, or push the crowd back.
There is no evidence that there was anyone, let alone an "official" at risk of immediate harm. The use of deadly force, even by a security guard protecting an "official" is only justified in the event of imminent danger to the person they are protecting.
If, as you suggest, the test was potential harm, then people tasked with protecting "officials" would have to be out daily shooting somebody who made a threat, or seemed like a danger, or who might decide to do something in the future. That's not the test under the law.

There was no immediate threat to anybody. The hallway was empty. We don't even know if there was anybody remaining in the offices. And even if there was, if there was another way out.
Add to all of that Babbit was unarmed and she wasn't a physical threat to anybody.

If she were St. Floyd, this guy would be toast. But not so. If you watch the tape, he actually panned about from his right to left to seek her out for the kill shot. May not stand for a first degree but second degree, absolutely.
Remember this, she was NOT armed and posed not a great threat.
I guess under the same concept as what that government attorney said, those swarming over the border if told they are entering illegally and faced by armed officers who blast them out of their socks, the agents would be exonerated.
