At least he already settled with CNN and the WaPo, and though it wasn’t public, presumably ended up with a few million.
It was actually surprising that some of the outlets went to court and some settled.
Quite frankly, I don’t understand how a court is able to bunch these all together and dismiss them.
Sandmann was obviously defamed; they called him a racist and claimed he was harassing that drunken Indian slob, when in fact the reverse was true.
For me, the funniest thing was when the media kept calling the Indian a “Vietnam vet”, okay, maybe he fought for the VC.
Life Site News:
Nick Sandmann lost his appeal in the U.S. Sixth Circuit Court of Appeals to sue mainstream media outlets for libel for their reporting on his 2019 encounter at the March for Life with leftist activist Nathan Phillips.
Sandmann, who was only a 16-year-old at the time of the encounter, settled his suits against CNN and The Washington Post in 2020 and settled with NBC in December 2021.
Defendants in this case include The New York Times, CBS News, ABC News (owned by Disney), and Gannett, which owns local newspapers across the country.
Judge Jane Stranch, an Obama appointee, wrote the majority opinion which Biden appointee Judge Stephanie Davis joined. Judge Richard Griffin, an appointee of George W. Bush, dissented.
“We do not have Obama judges or Trump judges, Bush judges or Clinton judges,” Mr. Roberts said . “What we have is an extraordinary group of dedicated judges doing their level best to do equal right to those appearing before them.”
Well, OK then.....
horse hockey.
And Roberts firmly remains a totally impartial Never Trumper.
So by the Court’s logic, you are a private citizen until the media slanders you. Then you become a public figure and can’t sue them.
In short, the media enjoys absolute immunity under the first amendment.
You and I? We are spreading “misinformation” and enjoy none.
Look for this one to be appealed.
This is how a minor is treated? The USA is not even a civilized country!
Sandmann’s attorneys will file for an en banc hearing which will involve all the judges on the Court of Appeals.
Haven’t read the opinion, but know that a plaintiff doesn’t become a public person because of their complaint becoming national news and coverage.
“So by the Court’s logic, you are a private citizen until the media slanders you. Then you become a public figure and can’t sue them.”
Correct analysis. But there’s no logic. These are political hacks.
Read the opinion. The majority opinion is bullshit.
Read the dissenting opinion. It’s brilliant. If the en banc hearing doesn’t go Sandmann’s way, this disse.ting opinion is a road map for the SCOTUS.
This is a case the SCOTUS would surely take
Another great American gets it stuck to him by a bunch of freeloading, black robed, Feral tyrants. The Blacks are right. Americans don’t stand a chance in this country’s “judicial system.” It’s weaponized against them.
Sounds like a couple far left wing bench biatches got him.
Riiight
.
Definition: Judge. A failed lawyer.
....so then the sandy hook parents by extention ALSO have no standing to sue Alex Jones right?
And didn’t that little queer “looking” kid that attempted to compete with Mike Lindell sue Laura Ingraham for defemation?
Nick should have sued Trump. Not a judge in the country would rule against Nick.
Well, there’s truth and logic and then there is the tactics and strategery of the Legal System.
Not to speak of the Big Bucks involved and flowing around.
