Judge Janet Bond Arterton is almost 80 years old and will officially retire in six weeks, on October 15.
She was confirmed in 1995 by a voice vote, which means no Republican Senator thought it was important enough to be on the record voting against her.
She is probably an old-school Progressive. Progressives took firm control of the federal government with FDR. The Courts had been a Progressive bastion from 1939 to at least 1990. Progressives believe the Constitution is outdated and needs to be neutered or a way found to "work around" it.
Judge Janet Bond Arterton's decision is a classic "work around".
Progressives believe all power should be in the hands of the government.
They actually believed in "science" as long as the scientists were committed Progressives.
