Will New Mexico's legislature uphold and defend the Constitution -- by removing a tyrant?

Do governors have the authority to suspend parts of the federal constitution? Legally, the answer is absolutely not. Four new lawsuits filed in federal court from New Mexico will likely result in a reversal of Michelle Lujan Grisham’s absurd declaration that the Second Amendment does not apply in her state during a temporary “emergency” she declared unilaterally.

What about the political answer to such a declaration, apparently without any consultation of the state legislature, let alone the US Constitution? Governors operate under authority granted by both the federal and state constitutions, not the other way around. A personal order to suspend either or both are acts of tyranny, especially through the time-worn, banana-republic construct of a declared “emergency.”

Governors take oaths to uphold and defend the Constitution — but so do state legislators. Will they take the action appropriate to their oaths when it comes to Lujan Grisham? At least two legislators have called to do so...

I know New Mexico ain't Texas, but she definitely needs to be knocked down politically.

It’s been said before, but it bears repeating: when you allow the government to override your rights in the name of ‘safety’ during an ’emergency,’ the government is then incentivized to frame everything as an issue of safety, requiring an ’emergency’ edict to properly and necessarily address.

SCOTUS also cleaned up comparable messes in the aftermath of WW1 and WW2, so there is a lot of case law out there concerning the limitations of emergency powers.

No. The legislature won't do anything.

It will be up to private citizens to do something. They had better be armed if they do.

Politicians do not respect anything else.

Damn right they won’t. The Democrats have nearly veto-proof majorities in both houses of the NM legislature; 45 out of 70 in the House and 26 out of 42 in the Senate, so as a heavily outnumbered minority there’s nothing Republicans can do (which is normally how they prefer it anyway).

Only Republicans routinely backstab their own party members, as long as that party member is a conservative, such as Ken Paxton in Texas.

OTOH Democrats march in nearly perfect goosestep at all times and will only sacrifice one of their own (e.g. Al Franken back in 2017) as long as they are certain the replacement will be similarly ultra-liberal (and therefore cost them nothing) and they can make political hay in the media by giving the “appearance of propriety”.

She is not stupid. She is lying about her reasons.

This is a test run for total cancellation of the second amendment by executive orders. Soon to be replicated in other states if it sticks.

The Democrats must disarm the general population as quickly as possible. They are already doing things that reasonable citizens might conclude they should be shooting politicians for doing.

Democrats do not care about violent criminals as long as they pick approved targets for their predation. More crime means more people clamoring for increased government powers.
