California Ammunition Infringements Back in Force… for Now

Californians have been free to purchase ammunition, much like the rest of the United States, from January 31, 2024 to February 5, 2024. On February 5, 2024, a three-judge panel of the Ninth Circuit, in a split decision, granted a motion to stay the decision of the District Court by Judge Benitez. Judge Benitez found the ammunition law to be unconstitutional for a second time.

In 2016, voters in California approved a ballot measure known as Proposition 63. The proposition created a system where gun owners would apply for an ammunition permit, which would cost $50 and be good for four years.  Ammunition vendors would be required to check a California list of valid permits before approving a purchase.  This system never went into effect.

Before the election day, when Proposition 63 was voted on, the California legislature enacted Senate Bill 1235. The bill changed and eliminated Proposition 63, and put Bill 1235 in place. Bill 1235 required a background check every time ammunition was purchased, along with numerous other requirements, fees, and prohibitions. Bill 1235 was to go into effect on January 1, 2018. The bill was challenged in the courts as unconstitutional on April 26, 2018.  On April 23, 2020, Judge Benitez issued an order granting a preliminary injunction to stop enforcement of the law. On April 24, 2020, a three-judge panel granted a stay on implementing the preliminary injunction.

On June 24, 2022, the case was sent back to Judge Benitez to consider the impact of the Bruen decision at the Supreme Court. On January 30, 2024, Judge Benitez issued an order granting a permanent injunction to stop the enforcement of the unconstitutional ammunition law infringements. From the order:

For a few days, Californians were able to purchase ammunition as most of the country can.

On February 5, 2024, the restrictions were allowed to go into effect again. California's defiance of the Supreme Court continue.

The gun and ammo manufacturers should get together and take out an ad in California newspapers that says they will not supply ammunition to any law enforcement agency that enforces gun control regulations. Cut the police off entirely.

The people who like California as it is now are staying there. The people leaving are primarily folks who are sick of California and are unlikely to vote for leftists. This exodus is not like the mass inflow from the Northeast into California in the '80s and '90s - those people came to California attracted by the tech boom, and they brought their liberal voting with them.

There are all kinds of ways around the CA gun roster and ammo regulations. Problem is, if you ever need to actually use your gun in self-defense and the DA finds you've skirted a single CA firearms law, you will be completely screwed.

Save the ammo you bought preban for self defense purposes. Buy out of state reloads for stockpiling and target shooting. I suggest reloads because they are less likely to be able to having showing when and where they were purchased.

Unfortunately that is all- too- often what happens. Many years ago Oregon had billboards “Don’t Californicate Oregon!” Unfortunately, that’s what’s happened to Oregon, Washington, Colorado, Nevada and Arizona and now even Idaho us under assault.
Such a crying shame really nice states get ruined , ironic too

Actually, that’s prohibited by the law. You would want to make sure the date and place of purchase of the ammo can’t be traced.

It may be prohibited by California law but nothing to prevent someone from loading up on ammo at a Az or Nevada gun show!

What is California going to do? Put road blocks up on the interstates to check for fruits and vegetables and AMMO?

Hard to believe that back in 1982 the voters in California REJECTED Prop 15 to register and ban handguns. It was guaranteed by the anti-gun forces to pass, but overwhelmingly REJECTED by the voters!

How California far has fallen. Like a virus infected cell that burst all those viruses are spreading and infecting other States like Colorado and New Mexico.

Granted enforcement would be difficult but I’m pretty sure I saw that bringing ammo into the state to get around the law is also prohibited. Do shell casings have any lot marks which could show where and when the ammo was sold?
