Supreme Court will take up the legal fight over ghost guns, firearms without serial numbers

WASHINGTON (AP) — The Supreme Court agreed on Monday to take up a Biden administration appeal over the regulation of difficult-to-trace ghost guns that had been struck down by lower courts.

The justices by a 5-4 vote had previously intervened to keep the regulation in effect during the legal fight. Ghost guns, which lack serial numbers, have been turning up at crime scenes with increasing regularity.

The regulation, which took effect in 2022, changed the definition of a firearm under federal law to include unfinished parts, like the frame of a handgun or the receiver of a long gun, so they can be tracked more easily. Those parts must be licensed and include serial numbers. Manufacturers must also run background checks before a sale, as they do with other commercially made firearms.

The requirement applies regardless of how the firearm was made, meaning it includes ghost guns made from individual parts or kits or by 3D printers. The rule does not prohibit people from buying a kit or any type of firearm.

Non serialized 80% receivers are still available and being legally sold, so, I’m not sure about this article.

Ghost guns are any gun you can make or even print on a 3-D printer.

There should never be a requirement on build-your-own guns.

A serial number stops no crime.

Criminals are already banned from having guns. Also, guns are illegal to use in illegal activities. A serial number does nothing, in these circumstances. If they are making them, the problem is that we have criminals making a gun they aren't legally allowed to have, with, or without, a serial number. If you can't trust a criminal to follow the gun law, punish and confine the criminal.

Our country requires a moral people to live in and run it. If we are not encouraging that, and letting in criminals, as every illegal actually is, then the problem is “us/US.”

The police need to do their job and the government should get rid of the criminals.

Banning kits or parts without a serial number you gave to government sources (they scoop them all up with visits to FFL and dealers), is unconstitutional.

The left is so good at creating permanent names for things. “ghost guns”, “star wars” instead of SDI.

Isn’t a ghost gun a “kit gun”, or a “homemade” gun, or some other more accurate term?

Ghost gun sounds like a whole new creation of deadly weapons, an entirely new kind of gun, something new, sinister, deadly and a unique threat that came out of the dark corners of the right wind gun world.

I remember pre-1968 when some firearms had no serial number on them. I used to have a .22 single shot. No SN.

I had a BB gun. No SN........Even they have Serial Numbers now, although the law doesn’t require it.................yet...........

Possession of kit guns has been made a felony in many states, including mine. The case is to determine the unconstitutionality of such laws.

As soon as someone figures out how to un-invent something, we can start talking about making something illegal to possess.

My favorite Clarence Thomas quote: “Sometimes bad policy can be Constitutional, sometimes good policy can be unconstitutional. That’s why we go to the text.”

In some instances, you can make the case that unserialized firearms are bad. But, there’s a stronger case under the 1st, 2nd and 4th Amendments. 5th too.

In most cases, it’s a single part, thanks to the insanity of the GCA of 1968. For many handguns, it’s the metal or polymer frame, sans trigger, rails, strikers, frame, barrel, etc. Just a bit of plastic.
