LAP dancers must pay VAT on their earnings from customers, a High Court judge ruled yesterday.
The clubs where they perform are not liable for VAT, Mr Justice Mann said. He upheld an appeal by Spearmint Rhino Ventures, which operates a chain of gentlemens clubs, against a VAT tribunal decision that the firm was liable.
He said the services in question were when a dancer provided private dances for a customer. A fee of £10 is charged for a semi-nude dance; £20 is charged for a nude dance, the judge said. In addition to those services, the dancer and customer can agree what is called a sit down.
David Milne QC, for Spearmint Rhino, told a hearing in January that the dancer has to pay the club for use of the facilities; there was no contract between the club and her customers. Mr Justice Mann said the dancers ply their self-employed trade at the club in their own right.
