Raleigh The man who once pursued rape, sexual assault and kidnapping charges against three former Duke lacrosse players who were later declared innocent by North Carolina's attorney general says he will resign. (Watch Mike Nifong's announcement.)
"My community has suffered enough," a tearful Mike Nifong said Friday during his testimony at his State Bar ethics trial to the surprise of the families and defense attorneys of the cleared lacrosse players, as well as others in the courtroom.
"Throughout the years I have served as a prosecutor I have always tried to do the right thing," a tearful Mike Nifong said. "In this case, I was trying to do the right thing. Much of the criticism directed to me in the is case is justified. The allegations that I'm a liar, however, are not justified."
Nifong said regardless of the State Bar's decision, it would not be fair to the people in Durham County to be represented by "someone who is not held in high esteem."
The North Carolina State Bar has charged Nifong with withholding critical DNA test results from defense attorneys, lying to the court and Bar investigators and making misleading and inflammatory comments about the players.
If the Bar's three-member Disciplinary Hearing Commission decides he violated ethics rules, he could be disbarred.
Nifong said he did not make all the mistakes alleged by the Bar, "but they are my mistakes."
"It has become increasingly apparent, during the course of this week, in some ways that it might not have been before, that my presence as the district attorney in Durham is not furthering the cause of justice," Nifong said.

He needs to be disbarred as well. This eleventh hour resignation is an attempt to avoid that.
I wonder how many innocent people he has hung.
They should review EVERY CASE he ever had any involvment in and make sure there wasn’t anything fishy...
He’s worked in the Prosecutor’s Office for, what, 30 years? I wonder how many of his cases will be appealed? What a mess!!
Resign? He should be incarcerated.
How is Durham County going to function without a DA. None of them are held in high esteem.
It’s a good first step, but this skunk needs to be prosecuted. He probably will after he and his dept. faces the mother of all civil lawsuits.
Now, on to Patrick Fitzgerald.
These people had money to fight. What about the poor guy who’s broke and can’t afford an attorney, or the media.

How about the guy who prosecuted the border guards on flimsy or no evidence. There were 3 supervisors there. & 7 other border guards.

Now here is what I wager. I wager he will be given some position in the Democratic party as a payoff for resigning...in an effort to quiet down the people in NC and elsewhere disgusted with the NC DEMOCRATS who first put him into office and then who would NOT demand his resignation after his crimes became so apparent.
My bet is what could not be done OPENLY for him by his fellow Dems will be done quietly. He will get State Retirement for one thing, I believe. A very nice retirement cushion. But my bet is there is some other type of payoff out there for him - a job, a board position, speaking engagements, something. A book of course. As others have said, he should not only be disbarred but incarcerated and every one of his cases retried.
Reform the judiciary and you reform the country.

So, he didn't actually resign. He says that he will resign. Did he give any indication when it will become official?
I’m sure the NAACP can find a job for him somewhere in their org. !!!
