The road is part of the implementation of NAFTA and the NAU.

Much of the land required to build the road will be acquired via the imposition of eminent domain.
 
Aquisition and funding of Right of way for the corridor in Texas will be managed by
the Texas Department of Transportation:
 
"Acquisition of right of way will be characterized by public-private investment, including financial participation by utilities, railroads, developers and landowners."
...
"Other possible methods of funding include concessions, the federal Transportation Infrastructure Finance and Innovation Act of 1998, various other federal programs and leasing right of way."

Yes, because the state will own the road.

Apparently it's a little more complicated than "CINTRA, is paying for the road."

That depends on what end of the crazy pool you're swimming in.
