Mark Moody said he was taking his usual nicotine break on the window ledge of his Peck Slip home on a hot August day with a cigarette in one hand and a cellphone in the other, a scant 12 feet off the ground.
He was shocked when a police car rolled up and two cops jumped out.
"Are you about to commit suicide?" one cop asked.
"If I was going to commit suicide, this would be a pretty dumb place to do it," the 40-year-old trial lawyer scoffed. "If I jumped from here, I'd just sprain my ankle."

Before he knew it, a beefy officer was inside his apartment, lifting him out of his own living-room window from behind, Moody said. The cop slammed him on the living-room floor while another kneeled on top of him and cuffed him, he claimed.

The on-duty psychiatrist apologized before quickly discharging him, Moody said.
"I talked to him for three minutes, and he said, 'Look, I'm really sorry. I apologize on behalf of the city,' " Moody recalled.
NYPD spokesman Paul Browne said, "Police responded to a 911 call of an emotionally disturbed person at the location. When police arrived, they observed the male sitting on the ledge talking erratically. Police Emergency Service officers were called, and the person was removed to the hospital for observation."

Come on, at least they didn’t shoot him AND his dog.
All that matters is the paperwork. Reality is irrelevant. Convicting an innocent person is just as good as convicting a guilty one.
I wonder what they would have done if they were there when I used to do somersaults off of our roof from 12' into the snow when I was younger.
Life in prison for disturbing the peace?
Quite a change from Mayor Dinkins days. Back then, a certain neighborhood crazy lady could spent her time naked and defecating in public on the streets of New York, while screaming obscenities as passersby. And, it was considered acceptable behaviour because there was “no law against being crazy.”
Certainly must have been a slow day for them.
They could have just gone by the old standby and covered point for the cash register attendant at the local Mr. Donut.
No pollution or disorderly conduct laws for crying out loud?
He was smoking. Surprised they didn’t shoot him.
I think the operative words here are “trial lawyer”. This guy will clean up.

Moody, who The Post found still takes his cigarette breaks sitting in his open window, sued the city and the police officers for $400,000 in damages on Dec. 8 in Manhattan federal court.
Off topic, there are buildings in that area that go back to the 1700s and that may be one. Those stars could be ornamental but probably are end plates for structural rods.

If the police got a 911 call from an emotionally disturbed person in the neighborhood, maybe that person got no help because they zeroed in on this guy.

I was planning on sweeping the leaves off the roof and cleaning pit the gutters tomorrow. Should I call the cops and inform them of this prior to getting the ladder out or wait until they show up?
OTOH, there are good samartitans out there. My elderly mother (who is in better shape than the rest of us and will outlive the next generation) was out pulling weeds the other day. A plane keep circling and obviously was watching her. She finally got up and waved. A few days later, the pilot saw her out in the yard again and swooped down to acknowlege her.
